They pay cash but it's up to the employee to do their own taxes. I don't need to sign on any more because of this job. I don't know exactly what I'm supposed to say to the council (for housing benefit) or the job centre.

What I read out of that is what we call here an 'hobble'.

I'd be very careful about signing off unless your confident that this work is steady and reliable.

They have to give you a payslip, it's a legal requirement. If they won't then they're hiding something.

Edit - that's not entirely correct - will you be classed as an employee?

Pedant alert - it's could have, not could of.

JC will still need to be informed of the money the OP is earning.
  • Let me clarify.

I don't have a contract of any kind with them. I come in, I work, they pay me cash out of the till or whatever, and I go home. I guess I'm not technically an employee. All I really need to know is what the council will require from me. Do I need to fill in a form telling them more or less how much I will usually earn?

You'll need proof of how much you're earning. You'll also need to inform the JC. Are you still claim JSA while working?

If you aren't technically an employee then what are you? If you claim HB you will have to give details of your employer. Which could cause problems going forward because they expect to see payslips to calculate how much housing benefit you are entitled to.

Out of interest and to give the thread a bit more body how many hours are you getting and is the pay rate above national minimum wage which for over 25's I believe is £7.50 per hour.

Also how reliable is the work.

If they plan to stay on JSA they'll need to declare the income. If they don't plan to stay on JSA they'll need to hand payslips into the council to get Housing Benefit.

The only other option is to go self employed which you can do and claim UC, but after a year you'll have a MIF applied which assumes you are earning a certain amount.

You can invoice them for your time and claim Housing Benefit as self employed.

I won't be getting payslips so what proof can I give them? I'll be signing off in a few days. I've only just started the job.
