  • Hi - I have a corporate amex card. While it was issued by my employer 8 years ago, I hold all liability (i.e. paying off the account each month and paying any overdue charges).

    I have writeen to Amex asking that they refund these charges (totalling £900), but they have responded on 2 occasions with the following. My second communication to them was via the financal ombudsman:

    "You American Express card is a charge card and not a credit card, and as a rsult it is not covered by the recent communication from the OFT regarding Late Payment charges. .."

    Does anybody have any experience with Amex card or Amex Corporate cards and are they correct?

  • Just received letter today re GE money/Laura Ashley - sent letters etc via FOS they passed on to FLA as charges go back to 2003 - anyway received a 4 page letter from GE money, they had already sent £39 back, now going to send an extra £70 - which I'm ok with - they wont credit back the £12 charges though, just the diff + interest:o

  • After sending off a reclaiming credit charge letter, I have received a cheque from Lloyds TSB which amounts to about one quarter of the sum I am trying to recover. Should I return this to the bank while I continue my appeal to the Ombudsman service or should I put it in my account and try to retrieve the rest?

    Just got the information back from beneficial that I requested under DPA, but it's not what I asked for. I asked for a list of charges on the account and/or statements for the past six years as I closed the account in 2005

    What I got was a dated list of minimum payment requests and payments made by direct debit to the account, somthing like this:

    04/01/05 24.27 billed finance charge
    27/01/05 27.00 direct debit payment
    04/02/05 25.06 billed finance charge
    01/03/05 27.00 direct debit payment
    and so on

    the letter says:
    "due to the account being dormant for a substantial amount of time, it has been purged from our system"
    but the account was only closed in August 2005

    my question is have they sent me just enough not to be in trouble with the information commishioner, do they not need to,by law keep detailed records for the past six years can any one give me any clues as what to do next
  • Hi cot1198, I work in the financial services industry (investments side though), and we're obliged to keep a record of everything for 7 years, so I would have thought they would need to keep their info for 7 years too. Hope this helps. Good luck!

    From reading martin's article on the main site I know banks are supposed to keep records for six years but how detailed I do not know and if they have lost detailed information on that account could they be reported under the DPA
  • I'm claiming back my charges from Capital One and Barclaycard.

    Sent the 1st letter some weeks ago. Barclaycard coughed up £90 straight away. The total with them was for nearly £400 (inc interest). Capital One left it right til the last minute and sent me a letter offering £56 (they also owe me nearly £400 inc interest).

    I sent the second letters off two weeks ago and as yet Capital One haven't moved at all - I've heard nothing and Barclaycard wrote to me at the beginning of the week saying that they would investigate and let me know the result by 6 October. Should I wait patiently with Barclaycard and will they pay out on that date? Or is it just a stall tactic and will I have to take them to court or FOS anyway?

    I'm expecting to have to take Capital One to FOS anyway judging by what everyone else has said.

    I have offered them a lower payment if they want to take it, in the interests of getting something back with very little hassle.

    What do you all think?
  • Barclaycard paid in full to me after letter 2. Mine was around £150 ish. No experience of Capital One but by the looks of it you'll have to fight them to the end.

    I have been offered 120.00 from Barclaycard even though I worked it out as 588.00 ex interest.I said send me that amount in a cheque as part payment and will accept the rest as well in a cheque they too are getting back to me by 6th October will update you if I hear anything , please could you pm me if you hear anything from them too.

    trying to claim back my charges from Morgan Stanley/Goldfish has anyone had any success
    they are looking into my complaint
    will post up when I hear anything
    still fighting for my money !!!

    No experience of Capital One but by the looks of it you'll have to fight them to the end.

    I had no trouble claiming from Capital One. One letter and I was refunded.
