I have recently put in to reclaim credit card charges with three banks. One of which is MBNA. The claim was for £750. They didn't get back to me within the 14 days specifies in my letter, so I sent the letter about court action. The following day I received a letter from them saying that they would pay £390 & they sent me the cheque.
I want to pursue it for the full amount but am unsure what to do with the cheque. Do I bank it as part-payment or would this be seen as accepting the settlement? If I just keep hold of the cheque will it become invalid?? Any help on this would be greatly appreciated.

Bank the cheque and send the letter explaining your accepting the part payment 'without predjudice' but will proceed with court action for the rest unless they refund it. That's what i done and 3 weeks letter i got the remaining amount.
The letter to send is somewhere on the site but i can't remember whereabouts.

I received a letter from my local County Court saying they are 'staying' my claim. I have returned a reply stating that the claim shouldn't be stayed as it is for credit card charges and not bank charges, which is why they decided to 'stay' the claim.
Does anyone know what the next stage is or how long i am likely to wait for a conclusion to the claim?

I have today sent a letter to Goldfish along with a cheque for £10 to ask for all of my statements so no doubt i will be waiting a while for those! My question is has anyone else had any success with reclaiming from Goldfish? This card is no longer active, i cancelled this last year but i dont think that this will affect my claim?
My other question is that i currently have a Barclaycard that i still use, i want to send them a letter also requesting my statements but i am a bit unsure about whether or not this will affect my card as they may close it down and want it paid off in full? Is this what normally happens or do they keep the card active even though you have a dispute with them over the charges incurred?

then once I get those I will be chasing HFCand Tesco personal finance credit card

I have just heard back form barclaycard, claiming my records are no longer with them as I closed the account in 2003 :mad:#
Stalling tactic I am sure, so I downloaded my FREE credit file from experian and supplied Barcalycard with the details of my account, I defaulted on it so they must know they have record on me!
Same for GE money, they claim I show no data from aug 2002 yet they sent me a copy of the credit agreement!!!!!!... Balls to that I was paying right up unitl Feb 2003!! with late payment charges every month. Im NOT letting them get away with that.. Ill report back once Ive heard from them.
At present 2x creditors outstatinding for SAR info. Capital one have replied and are providing my SAR info in due course and have supplied my full credit agreement.0 -

im no expert but I have requested details for 5x creditors with all 5 accounts closed in 2003.
Im getting responses and info every day so it doesnt matter your accounts are closed you can still claim!
As regards your credit card being potentially closed, I claimed for Bank account charges last year, I got a FULL refund and was in a small overdraft... no threatening letters to close account and my overdraft is still in use today (though not used)
So I know its not the SAME as credit cards but id be suprised if they make you pay the whole balance or close account. Be aware they may refund your charges to you card account IF successful.

Anybody claimed or claiming back CC changes off Natwest?
Already sent letter one and got a two page letter about the OFT and FSA agreement, complaint logged etc but can't do anything. I have sent the letter saying CC changes aren't included in this and gave them 14 days before court proceedings which is up on Friday and still not heard anything.
The claim is for £140 + interest, would you go to FOS or to court?0 -

I phoned HSBC to ask for my credit card statement, they sent me 6 years worth for free!
Halifax are pulling your chain I believe. Send them a letter from the template menu which is a "subject access request" under the data protection act, they cannot refuse this and enclose a cheque for £10. Ive written to 5x ex-creditors and only 2 are not playing ball right now.
definately recommend ignoring them , writing a letter using templates and enclose cheque for £10. I spent £50 on SAR letters, and just one of my creditors alone owe me £76 including interest, so ive made my money back if they pay up!

as far as I know the maximum charge is £10 as you are only technically asking for the charges not the statements. I just send a copy of the letter from here with a £10 cheque to HBOS card services (trinity address) and they sent all the info. No idea why they have told you that.
