I have recently put in to reclaim credit card charges with three banks. One of which is MBNA. The claim was for £750. They didn't get back to me within the 14 days specifies in my letter, so I sent the letter about court action. The following day I received a letter from them saying that they would pay £390 & they sent me the cheque.
I want to pursue it for the full amount but am unsure what to do with the cheque. Do I bank it as part-payment or would this be seen as accepting the settlement? If I just keep hold of the cheque will it become invalid?? Any help on this would be greatly appreciated.0 -

Just wondering if you think I could reclai the charges on my Credit cards.
2 years ago I settled 5 credit card accounts that had been passed on to collection agencies. I haven't kept all my statements, but still have the account details. When I settled the accounts, the agencies accepted reduced amounts in full settlement.
Would I still be able to claim for the charges and interest. I would have to write to each company to get the details of charges and interest applied.
Would I have a good case even though I paid a reduced balance?

This was so easy thanks to this amazing site.
Wrote a letter with £10 for my statements on the 14th June and got them on the 16th July. Sent a letter asking for £860 (full amount of charges + interest). Noticed on the 21st July they had credited my account with £300 so wrote another letter asking for the full amount or I will take them to court. Exactly a week later they credited my account with the rest of the cash!
Thanks so much Money Saving Expert... now going after Egg and Capital One... banks after that! Oh and I had paid off my Barclaycard before starting the process and have been able to book a ticket to Taiwan with the re-payment cashVery happy indeed
I have sent for my charges to be refunded 588.00 last week

just a post to say I have started my claiming process. After successfully claiming my bank charges back last year I am now starting on my loans and credit cards!
I was very fortunate to pay off 5x creditors in early 2003, but I am claiming all my overpayment and late fees, PPI plus interest back. These are the lovely people I am claiming against:- Barclaycard
- Lombard Bank
- MBNA
- GE money
- Capital One.
here's hoping I can recover them all! when I claimed my bank charges via HSBC I actually had to file a small claims court summons to get my money!

just got a reply back from Barclaycard customer services
as follows
thank you for your recent letter, your details have been passed to me in order that I may respond in my capacity as customer care manager.
I am sorry you feel the charges you have incurred are unfair.We believe our charges are both fair and transpaprent, and we make them clear in our terms and conditions, and on the reverse of every monthly statement.
I n your correspondence you have outlined a legal argument which you say supports your view.As I am sure you will appreciate Barclaycard is aware of all the information you have drawn to our attention.
I must inform you however, that we disagree with your legal analysis.
Putting the above to one side, as a goodwill gesture and without any admission of liability, I am prepared to credit your account with the difference between the charges that you have incurred and the current 12 fee.
this would amount to 120.00, plus 8% interest.
The adjustment will be confirmed on your next statement.
May I take this oppertunity to remind you that the best way to avoid similar charges in the future is to remain in your credit limit and ensure that your monthly payment reaches us with the required timeframe.
Should you have any further questions regarding this matter please do not hesitate to contact me. I f my reply does not meet with your expectations you may ultimately be eligible to refer to the Financial Ombudsman Service.
Further details of this service are available on request. I f I have not heard from you within 8 weeks from the date of this letter, I will close my complaint file in accordance with our usual practice.

I dont want it credited to my account cos its in credit already ( paid off last month) and I dont want to use the flaming account!!!( do they know anything about the credit crunch!!)
I was going to say I would accept without predudice the amount plus the rest and all to be sent in a cheque.
or do I do MCOL??

Hi all. I am claiming £600 fromHalifax in credit card charges. Yesterday i receibed a letter from Halifax offering me the difference between the bank charges and the £12 now charged. I would like to refuse this offer and go for the whole amount. Could someone please help me in wording my letter.
It would be much appreciated.

Just received a letter back today - claiming charges of £168 + interest - have offered me £36 - :mad: bloody cheek - I'm going to send second letter in the morning - received cheque today from Lloyds/easymoney £358 :jDEBT free:j0

Just use the template letter from the main article. Saying thanks for the offer but your not happy with it, so you want to take them to court or FO.
I think there is a need at this point to be willing to go that far.0
