I am currently awaiting my first, hopefully, agreed figure for refund of charges from barclaycard.
Do they legally have to refund to the card or can they pay cheque. I am now in a payment plan with the cards and it would be nice to have a little spare cash rather than it all go back to pay the cards. Although this will shorten the pay back in the longer time, would be nice for a bit of loose cash now

Hi I started my letters to Capital One and Barclaycard last year and was offered a measly amount from Capital One which I turned down and a no offer from Barclaycard. I did not take my claims further and am worried that I have now left it too late to go to the Ombudsman as the last letter I received from the credit card companies stated that they would consider my claim closed if they did not hear back from me within 6 weeks which has passed. Can anyone please advise if there is anything I can do.0

polesane- If you sent the SAR letter, but put all your infomation on it eg date of birth, full name, address where you have to account, and your credit limit (if known) then that should be enough for them to sent your statments.savings for 2012.. New year new me.. Going to save save save... and not spend spend spend. :rotfl:

sorry if its been asked before , just spent 1/2 hour looking but didnt find the answers.
okay so we have been told that citi are going to send a cheque for the full amount :j .
1/.As the debt was sold on to a DCA , will citi inform them that they have paid back our charges? ,
2/. If so will the DCA ajdust the amount owed to them , because the original debt to citi included the unlawfall charges? ,
I mean they brought the debt which included these charges which now turns out wasnt a true figure we owed to citi. so do they have to adjust the original brought debt figure to take off the charges.
say we owed citi £1000 who sold it and now we got back £200 in charges.
Was the original debt only £800 , and do they (DCA) have to reduce the original debt they brought , in accordance.
3/. Will the DCA expect the money we get all to be paid to them if we still have an out standing balance ? , cause were on a DMP.
4/. And if they (a DCA) do have to adjust the figure (this is a different different claim) and it turns out that the figure owed to them now means we have paid them to much , can we , how do we claim that back from the DCA.

hiya, I was wondering if anyone could advise me what to do next.....................
I claimed my charges back off Barclaycard and after paying the amount outstanding on the credit card, I'm left with £112 in credit on the card (which has been closed for the past 3 years so I cannot use it)
I have written to Barclaycard asking for a cheque for the £112 TWICE and they've still not replied! I've also asked them to inform Experian that the account is now settled so that it's not in the red anymore and they haven't done that either!!! They replied straight away when I made my claim, it took less then a month to get my charges back, so I can't understand why they're not replying now?!?
In my last letter I threatened court action if they didn't comply, but I don't wanna do this coz I can't afford the court costs, can anyone please tell me what I should do next??A MASSIVE Thanks to all you fantastic people who post the comps and answers:beer: :T :beer:

Update, received letter confirming the £129.60 on Monday, wrote back advising accepting as an interim without prejudice, but requested further £300 which I would accept again without prejudice. Checked my card online this morning & its been credited with a further £450. Think I will be accepting that:T

can anyone offer advice.
i have been with payplan for nearly 4 years due to several c card mess ups.
recently they suggested a remortgage to wipe all unsecured debts. We have done this and most creditors have accepted a reduced (slightly) payment as full and final settlement.
Now if we go after them for the charges which will run into several hundreds, could they come back and rip up the their full and final settlement ?
we thought we would be left with nearly 5 g surplus after the process, but its looking more like 1500 now,
would love to reclaim, but is it too risky ?0 -

just a post to say I have started my claiming process. After successfully claiming my bank charges back last year I am now starting on my loans and credit cards!
I was very fortunate to pay off 5x creditors in early 2003, but I am claiming all my overpayment and late fees, PPI plus interest back. These are the lovely people I am claiming against:- Barclaycard
- Lombard Bank
- MBNA
- GE money
- Capital One.
here's hoping I can recover them all! when I claimed my bank charges via HSBC I actually had to file a small claims court summons to get my money!
