hi all
great to read so many success stories on the site. the ease at which some members get charges back is amazing, sometimes after sending only one letter. i on the other hand have had no such luck. three claims are pending (egg, ulster bank and abbey/mbna) and all three have referred me to the fos without making any offer of any kind. in the case of the ulster bank i sent a leter asking only for a list of charges applied to my account. i recieved this information back with a curt letter saying no refunds would be given, even before i had asked for any!! talk about jumping the gun!! in all three cases i have used the correct templates and followed the correct proceedure to no avail ( so far) so i guess thats the frustrating thing from my point of view. there does seem to be a lot of inconsistancies over how banks are dealing with these issues. some are making offeres quite quickly and others not so. this becomes even more baffling when you see the same bank varying it responses. i know that the abbey are one of the tougher banks to deal with, yet i have read (albeit a small number of cases), where they havent put up much of a fight at all. anyway i hope the fos will back me in this fight and maybe force them into making some qesture. one can but hope.

Hi folks,
I just got my first credit card charge for a late fee which was due to me switching my bank account to A&L, and them not switching my DD's over in time.
I was wondering where I stood on this, on my statement the charge dates on the 03/04 and then my DD payment comes out on the 04/04, so 1 day late by the sound of it. Now should I get in touch with the credit card company and try to explain this or could I claim this back from A&L? Any help appreciated.

As it is a first time charge phone them up and ask them but do sort out when you dd goes out as you need to leave at least four working days for payments to reach the cc.0

Can anybody confirm the position for the following chain of events please.
Creditcard taken out with Natwest and Barclaycard.
Balance run up to £1000 including unlawful charges for going over limit etc.
Debt sold by Natwest and Barclayard to HFO / Global Debt recovery etc
Amounts now owed to HFO, GLobal debt etc.
Who do I reclaim the charges from - The Credit card companies or the Debt Collecting Agencies (DCA) ?
Secondly, as Im in the process of settling with HFO the £1000 debt for say for £500, can I still reclaim the unlawful charges that were added to take the balance to £1000 - if so who from? Or should I wait before I offer and ex-gratia settlement?
Final question - can anybody confirm if it is true that DCA are not allowed to add interest or other costs to debt other than court costs.
Reason for asking is HFO have added £35 a few times to the balance.

In fact they don't need to pay any interest at all as this is awarded by the court should it go that far.0

You claim the charges from the bank but any monies reclaimed will go towards the debt no matter who now holds this which will of course reduce any debt. You can't make an offer of £500 and then expect them to repay the full £1000 as this would mean you would be in effect be getting back the £500 that you didn't pay in the first place.0 -

I think there is a little confusion so let me be a little bit clearer if I can.
Let's take the example similar to what I orginally posted.
Balance owed to Barclaycard £1000 made up of £200 of unlawful charges and £800 of credit card purchases.
Debt sold from Barclaycard to HFO (I dont know how much HFO paid for the debt)
HFO now legally own the debt and require £1000 from me.
If I make them an offer of £500 in full and final settlement of the debt today, so that its paid today, can I still claim £200 from Barclaycard and expect them to pay me the cash? Even though Barclaycard previously sold the debt to HFO?0 -

I am looking into reclaiming credit card charges bt was wondering can i only claim back the charges before a certain date? ie before they reduced the late payment charge to £12?
