    You appear to have been misinformed.

    It's only unfair charges (from whatever credit card company) that are reclaimable. Have a read of the article linked to in the OP for more information. :)

    Yes you need to know what you are claiming for

    Have a read of the article linked to in the OP which should contain all you need to know about how to go about attempting to reclaim, starting with discovering how much to claim for those who didn't keep their statements (including the maximum cost of obtaining that information).

    can anyone help? i sent my( 1st) template letter requesting comprenhisive list of charges on my credit card with mbna. they wrote back confirming reciept of letter,then now after 40 days i recieved 2nd letter saying" please be advised that our records do not indicate that any insurance charges have ever been applied to your account" the £10 cheque was returned.when i phoned i was told the same and if i wanted statments it would be £4 PER SHEET!!! i asked for supervisor to ring me back and they said it would be within 48hours and they do not work thursday so it will be monday?? what should i do now??? thanks belbhoy

    Statements probably will cost you £4 per sheet (some companies charge even more!)

    But you didn't request statements, you requested a list of transaction charges.

    I would try once again by responding to their response and enclosing the returned cheque once more to them. If they still fail to provide the information they are required to do under the data protection act, then you should report them to the ICO ... but don't hold your breath. I complained to the ICO in February (unrelated matter) and received a response 2 weeks ago saying they have now passed the case to their 'Casework and Advice Division' and that they will 'contact me in due course'. They also apologised for the delay citing large volumes of work.

    It clearly says what to do in the MSE article under that link what to do if the company fails to abide by the appropriate rules.

    thanks premier after taking advice from ico i re sent the template letter enclosing previous letter and saying i had spoken to ico and give them 14 days as required to respond...wait and see.. thanks

    Right have submitted my mcol to egg for just over £200. Does anyone have any experience with Egg?, know what they are likely to do etc?. Am I right in saying I need to forward a copy of the charges to the court and then eggs solicitors?.

    Right have submitted my mcol to egg for just over £200. Does anyone have any experience with Egg?, know what they are likely to do etc?. Am I right in saying I need to forward a copy of the charges to the court and then eggs solicitors?.

    Presumably you only raised a court claim after you have exhausted all reasonable attempts to settle the dispute.

    That means as an absolute minimum, having already complained directly to the credit card company as well as sending a 'notice before legal action'

    If that has been done properly, the credit card company should already be fully aware of the amount being claimed and why you believe you are owed this amount (including the breakdown of charges that amounts to the total claim value)

    If the claim progresses to a trial date being set, expect to get an order/directions applying to the claim. These directions will typically inform you of a requirement to send to the court and other party copies of documents you intend to rely on. Until then, don't send anyone anything ... unless the other party requests clarification in the attempt to settle the claim by negotiation prior to the hearing, something that is also incumbent on both parties up until the hearing.

    Yes have written twice using the templates off this site, made it clear I was going to use court if they didnt refund. They have given there final response on the matter and over 8 weeks have passed since my initial complaint so theyve had plenty of chance to refund, and made it quite clear they have not intention of doing so. :)
