Hi All I'm new to this, but seems like i have had the same letter as above, any help or ideas would be greatly welcomed.
Seems a bit strange that all of a sudden FOS are backing Egg, has there been any changes recently ?0 -
I have been trying to get a result out of Lloyds Bank for three years now and have had nothing but hassle. They owe me £350plus interest and although I have done everything to the book I have had no 'luck'. I have now tried to claim on hardship grounds due to ill health and financially struggling - but still they stall me. I write and get a letter saying all the usual platitudes like 'we will be prompt and fair' blah blah signed Mr Squiggle (illegible signature) and then I chase this up politely and firmly and then get another letter from Mrs Squiggle saying EXACTLY the same thing. I also have a PPI claim on the go and the FO rang me up two months ago and said that they were finding in my favour and that I would hear within three weeks - two months later still nothing. I am getting so disheartened with all this crap but I will not stop until there is a result. How come so many people get a really good result with no problem within two to three weeks and yet both mine seem to be endless and out of proportion with the amount I am claiming.
Anyone would think it was £3500 I was claiming. Could someone from Lloyds tell me why this is taking soooooooo long to sort out and do I need to start doing something differently perhaps..
Some advice please from you guys would be so appreciated but dont all shout at once!!!!

Does the £57 offered equate perhaps to the difference between the £20 charge and the £16 cost Egg have proved to the OFT? That would seem to account for £40, so perhaps theyve added some interest too?
It's not anything recent, I think Egg proved the £16 cost was fair back in 2006 as the OFT were challenging it as it was above the usual £12 limit they generally automatically consider is unfair.
If so, it would be consistent with the FOS stance on credit card charges reclaims."Now to trolling as a concept. .... Personally, I've always found it a little sad that people choose to spend such a large proportion of their lives in this way but they do, and we have to deal with it." - MSE Forum Manager 6th July 20100 -

Mrs Stressed..
What type of charges are you talking about?
This thread is about reclaiming credit card charges.
Financial hardship doesn't come into it - that is something that may be claimed when trying to recover bank charges (but even if proved, there's no guarantee of getting the charges back)
... and you mention PPI charges. I suggest you ask about those in the PPI reclaiming forum."Now to trolling as a concept. .... yes that was the reply
so basically does that mean now i can't do anything about?
i.e is court an option
even the £57 had a deadline to accept which was last decemberDoes the £57 offered equate perhaps to the difference between the £20 charge and the £16 cost Egg have proved to the OFT? That would seem to account for £40, so perhaps theyve added some interest too?

Hi,
Is there anyone who has any ideas about my above post, about the FOS agreeing with Egg?0 -
As a consumer, you are not obligated to accept the terms of resolution offered to you by the FOS (but if you do accept them, the financial company are obligated to abide by the decision of the FOS)
You always have the option of attempting to reclaim charges via legal means (i.e. through a court)"Now to trolling as a concept. .... In short, the OFT will seek to challenge any credit card company that charges more than £12. But where a business operates exceptional factors, the presumption that a charge above £12 is unfair may not apply
The OFT started discussions with Egg over their £16 fee. Egg demonstrated to the OFT that because of it's particular business, the presumption that their charge of £16 was unfair was not necessarily correct. Consequently, the OFT decided to take no further action against Egg.
In light of this, the stance of the FOS is consistent in that it only usually offers a proposed resolution of a refund of that portion of charges that is considered unfair.
Your only option should you not agree is to bring about a claim yourself in court for unfair charges. Only a court can ultimately decide what is a fair charge and what is an unfair charge.
But the OFT obviously were convinced there was no, or at least insufficient, grounds for such a claim based on the evidence they received.
Edit:
This from the OFT website:... Exceptional business factors which may affect the level of a fair charge may include policies to prevent casual defaults as operated by issuers such as Egg (see note 4).
Only a court can finally decide whether a charge is unfair or not. The OFT has today set out a statement of its view of the law...
...
4. The OFT is not proposing that default fees should be equivalent to the threshold, and a court will certainly not consider that a default fee is fair just because it is below the threshold. Where there are exceptional business factors, so that the presumption that a default charge over £12 is unfair is not applicable, this does not necessarily mean that the current level of the default charge is consistent with the OFT's interpretation of the requirements of unfair contract terms legislation. But for example, where a card issuer has a policy of requiring customers to pay minimum monthly repayments by direct debits, such as that operated by Egg, and offers credit cards only to customers that satisfy a relatively high scoring requirement it may be able to set a fair default fee at a level above the threshold."Now to trolling as a concept. .... Hi guys, I'm a newbie here and I've recently decided that I need to get my budget under control (not an easy task) and I'm wondering if anyone can give me some advice on reclaiming PPI from several credit cards (Sterling Visa, Barclaycard, Egg) I've had over the years.
The main one is the Sterling Visa and I've had it for so long I dont even know when I first got it but it must have been at least 20 years ago when it was then called Bank of Scotland Visa. Anyway I recently cancelled the PPI which I hadnt even noticed to be honest until I decided to do a budget rethink! As all the time they've been charging me for this I had a personal PPI which I've had for years and didnt need the Visa one??? I have no recollection of taking out the visa or whether they even mentionioned PPI to be back then, all I know is they've taken a huge amount of money from me over the years for an insurance that I didnt even need. What's my chances of getting some of this back? How far back can you claim and where the heck do I start?? It looks messy!
Please help
