sent off first letter reclaiming charges - 14 days is up today - no response from them other than a letter stating "your DD has been cancelled" - funny I know cos I did it. About to send off next letter - will read up on it over the weekend - meanwhile anybody got any advice - new to this game but a quick learner and determined to see justice - will always post anything I learn or discover

    Cheers

    Hi,

Hoping someone can help me here.

I wrote to Creation Financial Services about an old store card I had. I requested a copy of the signed Credit card agreement I had signed and they have responded back saying that 'Under the circumstances, you will appreciate that a request under Section 78 of the Consumer Credit Act 1974 is not capacble of being valid'.

But information under section 7 of the Data Protection Act 1988 will follow within the statutory period.

I'm a bit confused as I didn't ask for any info under Section 78.

    Any help welcome.

    Thanks

Just read a FOS bulletin No. 40 saying should not offset against a credit balance, which they have done on my account. Any Advice??

  • Hi new to this forum and would appreciate advice from the experts. I make a credit card payment of 150 each month to mbna. i have jst recently managed to get down under my borrowing limit, having paid this amount for about a year, but the actually debt is only going down by about 40 a month. between all the charges, interset etc, it will take a lifteime. becasue i have an agreement to pay this amount, because i can afford it, just, at the minute, am i eligible to apply for reclaiming bank charges? also can i swap to an interset free card and try paying off the amount that way? really would love to be able get this sorted, its my dark cloud.
    many thabks

If you have late payment fees, overlimit charges then you can reclaim them all but if they are simply interest payments then I would look at balance transferring the account to allow you to make more of a dent into the credit card balance, hope that helps.

    Hi,

    me again,

Worte to Cap One on 21st Apr asking for late fees and gave them 14 days to repsond. I got a letter today telling me that they were investigating the matter further.

Can I send the second letter or wait until they respond again. There is no time frame allocated to this response from them.

    Thanks again.
