You might want to make the Information Commissioner's Office aware of this as it is a Data Protection Act breach.

Recently received MBNA card statement. My payment should have been paid on a Sunday but the full amount was paid off 1 day late on Monday. On £189 I was charged £12 late payment and a worrying over £17 interest. (Is that because I have since spent £2000 and am I therefore still being charged for that?). I have always paid off in full but Thursdays Alliance and Leicester Bank payment didn't appear on the ex A& L card until Sunday. Both claim to do faster payments up to £250 apart from Standing Orders and this was not a st order. I think it should have gone onto the card statement on Friday. Esp as they are both the same company. Am I justified in making a fuss?0

Hi, can anyone answer the following - have a LTSB banak account which is overdrawn and a loan and CC with them - they regularly take money out for cc which makes me go O/d so charged then they bounce DDsso get charged again. I have stopped all DD on the account, including for the load and cc repayments opened a parachute a/c to protect money. My question is if I pay off the o/d will they prevent me from closing the a/c so they can take money for loan and cc - have just eneterd a temporary repayment plan for all 3 with reduced payments. Would closing current a/c put this in jepoardy?? Any advice welcome

About to update my credit card charges with Tesco, I got my money back after a phone call!!! Yay!
But have another question. Capital One haven't replied to my late fee dead line, called them this am and tey couldn't have cared less, anyone know what to do next? Bit confused.

If you are going to sue them in court and have sent the second letter then follow through and sue them. If not then they have 56 days to answer you before you can go to the FOS0 -

They have the right of set off and I would presume that if you have a current loan from their bank account then they wouldn't allow you to close the account if it is still outstanding. I would reclaim any charges on the credit card account as that might help reduce the overall amount owing and therefore remove that issue of set off.
If you pay by Direct Debit then you can cancel the DD and pay online instead within the period in which you can do so if the date of payment is an issue.
I would make sure you cover the loan amount btw.0 -
The loan DD request says "please pay Eisis on behalf of Lloyds TSB. Does this mean I could close LTSB current account and pay CC and loan in some other way?
If I can pay off OD and get this set off removed would feel a lot happier.

I claimed back ppi and interest from MBNA (Virgin). Their usual tactic seems to be that they will ring you up and try to talk you out of it. Just stick to your guns (I had a copy of my letter in front of me and just kept reiterating what I had written in it) and refuting anything he said
Him "well it was all laid out in your welcome pack"
Me "What welcome pack?"
etc
Evantually I just said, "look I am not going to accept anything less than a full refund", got put on hold, and he came back and gave me the lot.

No written yet just getting my facts straight.
I think there has to be a written agreement to be enforced although a verbal will suffice as a means of sale but there is no proof that it was sold fairly. And had you really wanted it you would surely of asked for it when applying rather than what was probably a pushy after call.
So in theory theyve taken all this money which you can prove when there was no written agreement in place to do so which i'm fairly sure is necessary with financial products if they are to be enforced. No doubt had you tried claiming they would of bought this up.
Ps i'd keep at it. if you havnt written back then do so, make it clear that you will go to the fos if they dont refund. Its normal practice to decline first time so the fact they have offered some back in my opinion shows guilt on there part.0
