  • Hi there,
I have been in the process of claiming a refund from Egg for £379.86, after numerous letters, all which they declined to pay, I took my case to the Financial Ombudsman......who ruled in Eggs favour!!!!!!!
FOS said they believed (and Egg proved to them) that the £16.00 default charge was fair and that all Egg were willing to payout to me was the difference between this £16.00 and the higher £20.00 they used to charge, for however many charges I had at the £20.00 amount. Gives me a grand total of £44.12.
I don't know whether to just accept this measly amount and move on or whether to go further with this claim. I don't really want to have to go to court for £379.86!!!!! Or should I???

After burying my head in the debt sand, I have now decided to try to sort out my financial woes and this seems like it might help with my Credit Card balances.

Does anyone have any experience of reclaiming charges from Aqua or Vanquis and, if so, have you reclaimed the full charge or the difference?

    Thanks.

Do not trust the supermarkets credit/card automated machines !!!!

A few weeks ago, I attempted to pay for my shopping at my local Asdas via one of their automated credit/debit card machines using my Tescos mastercard. The machine rejected my card twice. I did not even get as far as entering my pin number. I then had the use my Abbey debit card to pay for my shopping as another option. Luckily for me, I have still got a copy of my receipt.

A few days ago, I contacted Tescos and was advised that my credit card had been debited twice for the transaction that was never successfuly completed on 2 occassions. I immediately disputed this and have now written to Tescos formally for them to refund me accordingly and also advise me how my credit card was debited with these two incorrect transactions when I had not even entered my pin. For info, Tescos are not agreeing at the moment to refund me the monies until I have formally written to them and provided them with a copy of my receipt.

I find this very concerning and will keep you all updated on progress.

Hi, I am probably posting in the wrong place! But I will start here and see where it takes me. To cut along story short, I have had a fair amount of debt over the past 5-6 years! I have managed to pretty much get them all paid. Two of my debts were my halifax bank account and my halifax credit card. Both of these were 'taken over' by blair oliver and scott. Not being the most clever person when it comes to money, I just thought this was normal (maybe it is)! anyway over the years I paid off my bank account overdraft debt via blair oliver, even refusing their partial settlement because I was told if I partially settled it would go on my credit file. I still have my credit card debt left but I have found information and posts on this website saying that Blair Oliver are a bad company and people who deal with them should request to see a copy of my agreement..? and maybe I shouldn't be paying them?.... also should I be requesting to reclaim my credit card bank charges!! As said not sure if this is the right forum to post on but any advice would be appreciated as am rubbish when it comes to knowing when the law is on my side!

    Don't worry about it.

Unless you are talking about one of these new, non-contact devices (where I think the limit is £10), you will have no problem getting the disputed charges wiped ... you didn't authorise them, and they don't have your PIN. Not sure how it even got to your account.

Not clear how these new, contactless sytems work exactly yet (I've not experienced them, only read about them), but from the evidence, I also don't think you've anything to worry about.

Nothing to do with reclaiming credit card charges though, not those referred to in the article this thread is about.

Hi DISCO,and welcome to MSE. :hello:

Yes you probably are posting in the wrong place as this sticky thread is to discuss the MSE article on reclaiming credit card charges linked to in the initial post.

However, this MSE news article may be of interest to you.
    http://www.moneysavingexpert.com/news/loans/2009/12/high-court-ends-debt-avoidance-loophole

However, in an attempt to bring this back on-topic, feel free to follow the guide on reclaiming credit card charges linked to in the initial post. :)

Thanks Premier for your response. For info, I used one of the old credit card readers and enter your pin devices.

Please note that I'm not worried about getting my money back as I know that will happen. However, I am concerned that these 2 transactions hit my credit card account, when I did not even enter my pin to authorise them. I have asked Tescos to provide me with an explanation.

The banks made a bif fanfare of how fraud-proof and relaible these devices were, when they first launched them. I'm afraid that I do not share their views or opinions at the moment.

Hi lush1. I had the same problem with N/wide last year. They made me a 'final offer' to pay me the difference between their £12 fee and the amount that I was charged for each credit card late payment. I wrote back and threatened to take them a smalls claim court if they didn't change their stance, and hey presto, 5 days later, I got all of my mony back. They advised me that 'it was a geture of good will'. Just use the MSE template letter, when threatening to take them to cout.

Please remember that none of the banks want to go court as they will need to justify their fees; in my case £12 with N/wide. They do not want to do this as their effort in processing late payment fees is minimal and a court would ask for the bank to justify their costs. The credit card fees process is automated and the only manual intervention needed is for someone to go to a printer, sign-it and then post the forms to you. I reckon it would take less than 15mins for someone to do and certanly does not cost £12-00.

Your bank, like N/wide with me, are hoping that you will accept their offer rather than go to a small claims court. Like I did, I suggest that you threaten your bank with the small claims court if it does not give you all of your money back. I reckon that they will concede before it gets to a small claims court but you may have to actually start the small court process before they do so.

Good luck and I hope the above helps.
