    i done that sent it away last thursday and recieved reply today that they are only willing to pay £57.32 instead of the £257.65 am claiming and adviced that i can take my issue to FOS

    should i go to FOS or court?

    You can still claim for credit cards. Take no notice what they say.

    I sent my first letter a month ago and phoned them up the other day to see if they had recieved the letter. What a load of rubbish they told me.

    I questioned her..as you have not recieved my letter although i have proof it was delivered 3 weeks ago, you are still telling me to wait 40 days before i can ring back and get some more info on this.. and then asked...is this a deliberate attempt to delay my claim and give me misguided information as if you have not got the letter after 3 weeks you will not have it in 40 days?? She went all silent so i told her thank you very much as i will now be sending a letter before action letter to several different Halifax addresses to make sure they can not fob me off again and will then procede to court.

    She virtually put the phone down on me.:rotfl::rotfl::rotfl::rotfl:

    As advised in previous postings on this forum, I suggest also sending an email to the the Halifax CEO Eric Daniels at [EMAIL="meric.daniels@lloydstsb.co.uk"]eric.daniels@lloydstsb.co.uk[/EMAIL] with your 'threatening court action' letter attached. My recommendation is email before any letters.

    Go for the 'threaten court action' letter. I used this with the Nationwide and soon received a full refund of my charges.

    Hi mcmac,
    Pls ignore my previous posting. Take them to court. They won't debate it as they would need to divulge their true costs, which in turn, would then create a precedance and lead to further claims against them. They are trying to twist your arm and attempting to stop you escalating. You could pursue the FOS route as an alternative but it will probably take them several months before they can look at your case.

    thats the one i sent 'threaten court action' on thursday last week and recieved the reply on thursday this week
    only willing to pay £57.32 instead of the £257.65

    update i looked up martins website i can go FOS or court i think it will be court quicker option as am in scotland looks like i have to fork out £65.00 for this

    is anyone here from scotland that had similiar issue please advice

  • I sent a SAR to Sainsbury's bank over 40 days ago. They sent me a letter 2 weeks ago saying that they had received it.
    When a company has 40 days to reply, is it the information they have to give within 40 days or just a standard letter saying they have received my SAR?

    Can someone please confirm if you either have to claim seperately for two credit card accounts even if they are with the same bank

    Or whether you can claim together in one letter giving a breakdown of charges for each account.

    The halifax have yet to acknowledge after two letters sent and the next stage is court action but i dont want to start action only to be struck out.

    I have included both accounts and listed all charges for each account seperately and totalled them up seperately and then given them a total amount to refund.
    Will i still be ok to start court and put the particulars down for each account??
