    I'm contacting you further in relation to your email regarding your cahoot credit card account.

    We do not accept that cahoot charges are unfair under the Unfair Terms in Consumer Contracts Regulations 1999. The object of these Regulations was not price control nor were they intended to interfere with people's freedom to agree the terms of their contracts.

    It is well known that banks make charges and cahoot charges are in line with those of other banks. The terms and conditions of the account and the charges that apply are clear and fair and were provided to you at the time you opened it. You freely agreed to the terms and conditions and the charges when you opened the account. You were not under any obligation to do so and could have gone to another bank if you did not agree to the charges. Equally, you are free to move your account to another bank at any time if you do not agree with the charges.

    In any event, we do not agree that the charges are disproportionate. The charges are reasonable and proportionate to the administrative costs incurred by cahoot.

    I've considered this matter carefully and am not in a position to refund the charges you've incurred.

    I hope you can understand the reason(s) for my decision. If you are unhappy with my decision, you can refer your complaint to our Central Complaints team.

    You can either write to: PO Box 5129, Abbey House, Grafton Gate East, Milton Keynes, MK10 1PQ,
    Email: complaints@abbey.com or,
    Call: 0845 600 6014 or Type talk on: 18001 0845 600 6014.

    I would advise them that the OFT believe that their charges are assessable for fairness under the Unfair Terms in Consumer Contract Regulations 1999 and in their report on default charges stated that only a court can decide on a fair charge. Ask them for a full breakdown of their costs which if they cannot produce will be forced upon them through the County Court. See if they budge then ;) ?

  • Sorry - I'm sure this has been asked time and again, but I can't face trawling 94 pages for an answer, so I'm taking the bull by the horns, and asking here.

    I had a Lloyds TSB Trustcard which amassed charges amounting to £418.50 between November 2000 to September 2006, when I finished paying the balance in full and closed the account.

    Am I still able to reclaim these charges (and any interest??) even though the account is now closed?

    If so, can some kind soul please point me in the direction of a template letter, or a step by step guide as to how I would word letters, or go about reclaiming.

    TIA - and apologies for asking what is surely an oft-asked question.

    No worries. Yes you can definately still claim. Makes no diffference that the account closed, old or even purple with yellow spots. Get your reclaim going.

    At the top of the page is a tab called RECLAIM, hit this and half way down the page is a link to Credit card charge reclaiming. Nice and easy step by step reclaiming procedure will follow.

  • Just reread your post again, and one question do you still have your statements going back to the 2000 charges ? Just a safeguard measure thats all . Will explain when you answer.

    My files are all up in the loft now (closed account - didn't really think I'd ever need the stuff again, since reclaiming bank/credit card charges hadn't been "invented" then!), but yes, I believe I have still got the vast majority of statements. I'm a bit of a hoarder of paperwork - I knew there would be a time when I'd be grateful for that! I'll send the husband up into the loft on a search and retrieve mission tomorrow.

    Now, I'm intrigued to know what you're going to say now :D

    I've just prepared a schedule of charges and done an initial letter to them, so won't send them off until you next post.

    ETA - having used the calculator in the link you gave me, it turns out that my initial calculations had gone back to 2000, but as I understand you can only go back 6 years, I've reduced it and the charges amount to £256, with a total of £340.87 with interest added.

    Hi, I am just starting to go through reclaiming credit card charges, it might be a nice change to get nice letters !! Anyway I have got one lot of statements through from Barclaycard today to get me going :)

    Does anyone have the address for letter 1 & 2 for Mint? I have been looking for a while tonight and can't find it .

    Hi everyone, hope you're all well.

    Followed Teenie D's advise and phoned capital one yesterday about not receiving list of charges, threatened them with information Commissioner and lo and behold, full list arrived today by recorded delivery.:D

    Big thanks Teenie, added up charges and they came to £400 plus £107 interest. Bonus was that they sent a copy of my cca and i had ticked that I didn't require ppi but they've been charging me for last 6 years so sent a letter claiming that back as well. :j
