  • Hi everyone
Im new to this forum. My post is about reclaiming credit card charges and is this possible under hardship rules if I am not in hardship now but was at the time of being charged?
I bank with Natwest and since the beginning of the year I have been making payments to them on my credit card via CCCS. I have a debt repayment plan with CCCS which started when I was unemployed and is continuing with them until payments to my debtors have been fully paid.
The thing is that Natwest have continued to charge me on my credit card balance even though they are receiving payments from CCCS on my behalf. I wrote them a letter explaining this and now they have sent me a form to complete declaring hardship. This form would have been appropriate at the time when I was in hardship, but I have been in full time employment for several months, so how can I declare myself to be in hardship now? They will just dismiss my claim for a refund of the overcharges as they will say that I am not currently in hardship as I am receving a salary.
Is there anything that I can do?

Hi I had the same problem with Capital One (50 days after letter sent and cheque cashed) I phoned them up on Monday to find out why they hadn't sent anything out to me, they were very apologetic and I received what I needed today, away to work out what to claim back. You can go to the Information Commissioner but it may be worth a try phoning the credit card companies first. Good Luck

    Hi Teenie D
A big thanks for your advice, will give them a ring on wednesday on my day off.:D

On credit cards whether you are in hardship or not is not relevant when reclaiming the charges since they are not bank account charges. There is no hold on claims so reclaim the charges so start the process of reclaiming your credit card charges since there is no relevance on hardship or not on the type of claim you are doing.

    Hello Sarah

Yes you can claim back the £12 ones as well, I have done this successfully already. Just follow the template letters.

    Hope that helps :D

Yep 100% definitely since no court has stated that the charges are fair so start the process and keep us updated if you need more help ;)
