Thanks for your reply. So I should ask them to go back and put a claim in for the full amount?
let's put it this way, they charge you a percentage of the final amount reclaimed. Surely they would want to get more back since there is no Legal Ruling that £12 is a fair charge for credit cards. Tell them that an amateur could do better and yet they are claiming to be experienced in these claims.

I've just tried to ring them but as always someone is going to ring me back. I really hope that they haven't lost me the chance to reclaim hundreds! If they have settled then am I stuck with that decision?
  • Can I reclaim charges from a card that I no longer have (have since closed the account but was charged in the last five years)???

Hi, Just about to start claiming my charges back from 2 of my cards. The accounts have been closed and only last week had been passed to a debt collection agency. When I send the first CCA request do I send it to the original providers (MBNA) or do I now send this info to the DCA? I am guessing its the original providers as its them I am in theory looking to claw back my charges.

    Any help would be appreciated.

Yes, the financial providers and any monies you may get awarded will go towards your o/s debt.

    Good luck.
If you see a penny, pick it up, all day long you'll have good luck !!!!!! :D

I can avoid those charges going to outstanding debt by ensuring I mention that I require the charges paid back in the form of a cheque though can't I?

You can but the debt still exists and it is still incurring interest so it would not be in your best interests to do it this way.
