  • To cut a long story short, claimign back money from capital one c/c, not offering enough so passed it to the ombudsman.

    They wrote back sending all the documents i have sent them asking for the letter of final response from them but i do not appear to have received it, yet in subsequent letters from capital one they word it as " as we have made our final offer".

    I have ticked the box on the form for the ombudsman to say they have given their final response, shall i untick it and send it back as i havent got the final response letter from them or shall i send it back highlighting the letters from them where they say "we have made our final offer"?

    No because I think it is reasonable for you to assume that the wording "we have made our final offer" as being the same as "our final response is".

    As anybody got the address for Lloyds for requesting statements please !!!
  • Iv put in my small claim with Lloyds. They are refusing to pay out until the court case thing goes through :(

    If it is a bank charges case then the case will be stayed pending the completion of the OFT test case issues(which includes the current litigation and any further litigation after that result regardless of which side wins that part of the case).

    Hi, I am in the process of reclaiming my credit card charges through Allied and General (simply haven't had time to do it myself recently so thought it better that keep putting it off). The thing is that I have just found out that they will only reclaim anything above a £12 charge. They have received my statements from one credit card and the figure they come to is just £26!! I'm predicting that my others may be the same.

    My query is, as I know that I have had a lot of £12 charges over the years! Am I able to reclaim these myself even though Allied and General have made a claim for the other charges? And is it worth it (as in likely to be successful?) Any help would be great.

    Tell Allied and General to read OFT 842 and point 1.14. Even an amateur like me can tell the pros that it states that only a court can decide a fair fee.

    EDIT: that is just plain sloppy work for them to do this.
