    Hi everyone! I'm new to the forum so please bear with me.
    I have sent off my credit charges reclaim letter to Sainsburys Bank 2 weeks ago requesting £600 (charges and interest). The responded offering £156.00 which is the difference between £12 and £25 and they feel their charges are fair. I have sent the 2nd template letter saying I will only settle for £500, otherwise will send to FOS. Will hopefully hear from them soon!
  • Do you have priority debt arrears(mortgage/.rent, council tax, utilities)?
    This is specifically on the hardship issue.

    The credit card one should be easier.

    Just had offer of 255.75 today for credit card - I'll be accepting without predjudice but still claiming the rest.

    With regards the hardship claim, I have n attachment of earnings of 180 per month on council tax for over 3k arrears and bills, etc so yes I should say I have priority debts. Any info would be graetfully appreciated.

    attachment of earnings is technically a payment plan. Are any other priority debts on utilities, mortgage/rent?
    Credit cards/loans aren't priority debts btw. and nice one on the £255.75(keep at em).

    Unsure reclaimer here!

    I wrote to C1 on 5/6/09, they wrote back with the usual, we're right, you're wrong, how about you accept our £40 'goodwill offer' :rotfl: and go away?

    Wrote back saying I wasn't going to accept the goodwill offer and they got back in touch yesterday to say things along the lines of...

    "confident our default sums are both fair and legal and I'm disappointed to hear you're considering further action. The OFT hasn't told us we're obliged to refund any default sums, and we've offered refunds as a gesture of goodwill. I won't be refunding all of the sums you've asked."

    They go on...

    "My £40 offer is still open to you. I won't be increasing this, as it is my final offer. Financial regulations require me to advise you that this is my final response in relation to this matter. However, you now have the option to contact the FOS within six months from the date of this letter. Again, I look forward to receiving your signed settlement form so we can put this behind us and save the FOS' valuable time."

    Sorry for most of the letter content in my post but I'm getting a bit worried I a) won't get my charges back and b) will have to be dragged through court to be told this news. :eek:

    Has anyone else received similar letters from the lovely folks at C1 and continued, successfully, with their claim?

    Capital One? This is their usual stuff. Sue them and they will pay up.

    Yeah it is Capital One, I presume NWSM when you say sue them you mean contact the FOS and it won't even get to court before Crapital One pay up?

    Do a quick search on Captial One on this thread and you will see that suing them seems to be the only thing they will listen to. Unless you want to offer them one last chance to settle amicably?

  • Hi guys, I have 3 credit cards, 2 of which (capital 1 and mint) are over their limits and have been for some time. I've incurred ALOT of charges on these cards, however I don't remember my charges ever being more than £12, £12 for a late/missed payment and also £12 for being overlimit.

    My 1st question is, is it worth my while trying to reclaim all these £12 charges?

    And my 2nd question is, can I write to the companies and ask for a list of my last 6 years of charges, in the same way for bank charge reclaiming?

    Bank charges are slightly different since there is an OFT test case.
