Can someone please help us.
I successfully claimed back £1600 on my Halifax Credit Card at the start of the year. However in July of this year my partner and I started a claim for her Halifax Credit Card charges totaling £1800.
We ended up having to make a claim on MCOL, however the case got stayed in September and after hearing Martin on Radio 2 saying that credit card charges claims can't be stayed. We followed Martin's advice and telephoned MCOL and sent them a letter explaining that the case was for Credit Card charges and not bank charges. Anyway to cut a long story a little bit shorter, we received a letter back from MCOL saying that our case had now been passed onto our local county courts, and once again we would have to pay another hearing fee of £180.00.
Now the problem is that we have received notification back from Southport County Courts saying that we have a court date in January 08 at 10am. Both my partner and I are quite worried as neither of us have been to court before and haven't any idea what we need to take to prove our case is legit. So could someone please please help us? Thanks0 -

When our IVA was agreed a clause was put in to say that any monies due to us from the incuded companies would have to go into the IVA so we have adheared to this - hopefully we will end up reducing the term if we can claim enough back - after all, the charges are mainly the cause of us not being abl eto pay the bills!!!
Hi
Thanks for your reply.
Have you contacted your IVA provider to get confirmation that any charges reclaimed will actually reduce the debt that you are currently paying towards as mine reckons it will be used to clear the 'outstanding' amount that i understood to have been wrote off?
I'm sure this is illegal but have yet to get confirmation of this. If i do i will let you know.0 -

Have you been asked to forward to the bank and the court a court bundle? Generally you will have been given a date by which time you have to have this in.0 -
I sent a SAR to GE Capital back on 2 November via recorded delivery and I haven't heard anything back as yet. Is it normal for them to take so long? Should I be pestering them or just give it a bit longer?0

Hello folks, Im looking for a bit of advice about my barclaycard claim. Im claiming around £500 but have had no luck, so ive used the moneyclaim service, today ive found out that barclaycard have not only aknowledged but also entered a defence. This is really concerning for me as im not very good at public speaking and cant really afford time off to go to a court hearing! I didnt expect to have to go all the way for a small amount like this (my fault i know!) Does anybody have any advice?
Thanks0 -
Hello,
Im also awaiting a court date, but really really dont like the idea and am quite scared about it all! Should i contact the credit card provider? What about explaining i'd settle for a lower amount? Or telling them i intend to bring a local journo or something? im unsure about the legalities of telling them this? (I do actually intend to talk to one about my claim though!)
What's the best idea now?0 -
I've asked Goldfish for a list of my charges but is it correct that they have 40 days to produce them ????0

I used martin's templates, sent them a cheque for £10, when I recieved all charges dating back to 2001 it all totalled about £360. I wrote back using the 2nd template and then they wrote back offering £126 (which was the difference).
Thankyou Martin! :money:
Yes i could go on and ask for the full amount but my life is a bit of a rollercoaster right now so im just happy to have this little bit extra xmas money0 -
hello people!!
just wondering if anybody may be able to help me
i had a credit card with natwest some years ago, and the charges spiraled out of control, up to a point i wa not able to make any repayments, i origianaly owed about £900.00 which was easy for me to make the payments on a tight budget, i am a single parent, and everything was okay, until i missed a pyment, and eventually owed them £1700.00, this finally went to a debt collection agency, and im still paying £10.00 a week now, all these years later, will the credit card company not refund me from the £900.00 onwards, the problem is, i dont have any statements, or anything, just the name of the bank, and of course my adress at the time ect.... should i try and amke a claim. will this be possible?0 -

definately! As long as its within 6 years. Just request copy statements using the details you do know You may have to pay £10 for them but its worth it.
You dont have anything to lose really!
Good luck0
