    Wrote to monument to ask for all charges, they gave them free of charge as a good will gesture.

    Wrote to them asking for the difference between charges and £12 - they wrote back to ne 4 days later offering me the money but without interest - they said they would credit to the account but since they are included in our IVA I have had to write and ask for a cheque so that we can pay onto the insolvency practitioner.

    I am currently on an IVA and wondered if you had claimed any other charges and been sucessful, and if so, did you have to pay ALL the money to your IVA provider?

  • Am i posting on the wrong thread? Have asked twice now for advice (16.11.07 + 25.11.07) but have been ignored? time has almost run out for me, only a few days left for me to reply to citi cards.

    God they are too! They had an address at the bottom of the letter for a different financial Institution. Would this be the storecard equivalent of the FOS? If so is it worth writing too. I must admit I'm happy they refunded at all and realise at that time it was my fault. It was just a long shot and they responded very quickly:cool:

    I don't know if they're right in what they are saying- but it would seem they could be tryin to scare u. At the end of the day, the charges have been applied in all cases by going over our overdraft limits! One for going over and then another for having direct debits bounce.

    If you read everyones case, the claims are always transferred to the local county court of the claimant. It doesn't say where you live, but say if you lived in Northampton, it would be transferred to Northampton rather than Salford.

  • How long did your claim with Topshop take and how many letters? I wrote to them for both Topshop and dorothy perkins and have been offered only 1/6th of my claimwhich I've accepted as part payment. Any advice appreciated thanks!

    hi i asked for my charges back from topshop with the first sample letter on the website and within couple of weeks they refunded me back. sometimes it just takes one letter which topshop took me but sometimes you have to write a couple. just keep writing to them and advice them you accept it as part payment but take them to court or write to FOS or the remaining

    Hi, look at your agreement. When our IVA was agreed a clause was put in to say that any monies due to us from the incuded companies would have to go into the IVA so we have adheared to this - hopefully we will end up reducing the term if we can claim enough back - after all, the charges are mainly the cause of us not being abl eto pay the bills!!!
  • in response to this asking - GE Capital which is covers Dorothy Perkins, Debenhams, BHS, Burtons, Wallis and Evans (and maybe more, not sure) are paying out. In my experience not straightaway - and they put up a good fight - but once you hit MCOL, they settle. So go ahead
