    hi i have a credit card with halifax, and in march this year i went over my limit by about a fiver, they didn't send me my statements as they where going to my old house, i had changed my address with them last year, but they said they didnt have it, so i didn't know till recently that i had gone over my limit, now casue of that they have been charging me a £12.00 over limit fee each month, as im making the min payment so after intrest its not covring the over limit so my balance is going up each month, last month i recieved a statement for the first time. Can i claim the charges back and if so how, i really would like to get this card paid off

  • Does any one know if egg money can keep any cashback money I am due (£75) if i reclaim over limit fees (£65)?? I know i am at risk of losing the card, I already have a replacement one ready.

    I have got as far as sending the second letter to egg to request over limit fees back.

    Maybe i should have waited until i got cashback first.

    Does the reclaim procedure only relate to charges and not interest?

    I missed a £5 monthly payment on my Virgin Card (interest-free deal) as the statement never arrived. I was charged a £12 fee PLUS £49.70 in interest on £2,960, even though I cleared the balance in full at the earliest opportunity (about 3 weeks after I should have paid the £5). I reckon the interest rate is about 33% pa on the basis of the 3 weeks.

    Do I have any case on the basis that they failed to inform me the £5 hadn't arrived until the regular statement arrived about 3 weeks after the missed deadline? (I can't imagine the original failure to receive the statement can be blamed on Virgin.)

    Any advice welcomed.

    If you arranged an IVA with your credit card companies, can you still claim charges back?
  • Any one help? I have already been so successful with claiming my bank charges but now i want to go for my credit cards. However i have got rid of them and have no details of my credit card numbers, so how do i write to the credit card suppliers asking for the statements if i dont have any details myself? Look forward to anyones response. Thanks

    Hi ( not sure where to post this )

    This is my first post so be gentle

    Thanks a million to those of you who have provided invaluable help to myself,and I'm sure, many others.

    I have a couple of questions.

    I'm claiming back the charges from Capitol One for my Dad, he very foolishly took a Capitol One card and before he knew it was in big trouble! The debt was handed to an debt agency to chase payment.

    When he recently took ill, I discovered the letters demanding money. I contacted them and took over payment of the debt, paying £15.00 per month. The amount owed is/was £300

    I wrote to Capitol One requesting his charges back which totalled £420 ( with interest)
    I've received a letter offering £136 as a full and final payment. They stated if accepted , they would inform the agency of the reduction, basically taking it off the original debt.

    My 1st question is: Is there any way ensuring this money is paid drect to my Dad and for me to continue with the payment plan?
    I'd like my Dad to have the much needed cash.

    Question 2: I don't see a second template letter for credit card reclaiming, do I go straight to MCOL or do I respond to Capitol declining the offer?

  • Question 1, no as generally any monies reclaimed will be paid toward any debt held by Capital One.

    Question 1, write back to Capital One and say you will be continuing to court or the FO for the full amount of your claim and then do which ever you decide one.

    If you are claiming on a closed account and don't remember the account number you need to send the bank any relevant addresses, name and current address and your date of birth and they should be able to trace your account.]

    Thank you for the above advice but will the bank actually supply this information, simply as return of post. I had a horrendous experience with mbna some years back. I would now need to ask them for my account number prior to making an enquiry on the massive charges they screwed me for. They do not seem like a friendly institution that would readily co-operate with this type of enquiry.

    Just to say the same has happened with me. I had 2 seperate c/c accounts with Barclaycard-1 with visa 1 with mastercard. I put in my claims with mcol & my cases were 'stayed' pending the oft decision. I appealed againt this & have just been informed that whilst the 1 account will remain 'stayed' the other case goes to court at the beginning of December-they are both for exactly the same amount so go figure on how they the court has come to its decision! Will of course appeal again against my 1 case being put on hold still-Will let you know how I get on & good luck with your claim.
