    Just been awarded £64.99 goodwill !!! from HSBC , I requested £51.38 using the calculator on MSE . They stated that they have included interest at the contractual rate , does that mean the rate applied to the card ? , as opposed to the MSE calculator.
    This account was closed in Dec 2006, however opened a new card with them in Dec 2008 , HSBC are insisting that the refund from the old card is paid against the balance on the new card.
    Ultimately that is where the payment will probably go , however I believe I should have a choice on this, can anyone help with precedents / laws on this before I refer to FOS.

    The story:
    November 15th, sent letter.
    November 24th, BC offered goodwill cheque £190. I replied, accept as part-payment without prejudice but still want rest.
    December 8th, sent BC cheque for 800 with interest. :j:beer:

    just thought I'd let you know that I've managed to reclaim £536 in charges from MBNA (virgin) which includes interest at 34%!!!!! :j

    I originally wrote asking for the statutory 8% interest, they replied offering a difference of £20-£12 which was £39. I wrote back advising that I wasn't happy and that I would like the full amount. I also added that after seeking legal opinion I was also entitled to reclaim the interest at the contractual rate of 34%! (use matrixds calculator or stoozing.com to calculate the annual contractual rate)
    i then received a response advising that as a gesture of goodwill they would repay a further £497 to my card, equating to approx £537!!

    I would say always try for the full contractual rate, even if you have already applied at 8% and had a payout, it's worth the price of a stamp to try for the extra amount!

    By the way, Lambrusco cowboy, the process can take any length of time, they have up to 40 days to respond with the actual charges, then up to 2 weeks for each letter, however, i have now reclaimed 5 different cards, one took only 2 weeks (full amount back with 1st letter) to about 2-3 months with MBNA - but remember that the longer it takes the more interest they should give you back!!! :rotfl:

    Thnaks to everyone again, I will post an update soon, but I've had about 3K back so far for me and my mum's cards, and still got about 11 cards waiting for a response!

    More difficult this time.

    Provider: MBNA A&L
    Amount Reclaimed: 2140
    Amount they paid: 2213 :j:D

    The story:
    August 25th, sent letter, asking for refund on charges.
    September 15th, A&L replied they refuse to refund, saying charges fair and in t&c. September 15th, I sent another letter with charges saying I will still pursue. (28th) They replied with 'will investigate'. Need 28 days.
    October 30th, received another letter from A&L still investigating saying they will reply in 28 days. I replied interest mounts and they have 7 days before 'letter before action' (LBA).
    November 9th, they send goodwill cheque £170. I replied, accept without prejudice as part-payment but still want rest.
    They replied saying they need to investigate further. I said fine but gently threaten LBA again. :D
    November 30th, A&L send cheque for 2043! :j:beer:

    I wasn't tight with the deadline but will be with the next two MBNAs as they like to take the p!ss.
  • How can you still claim when the banks have won??
    Cartel Client Review are saying that you can still claim back loans, credit cards (before April 2007) and mortgages, but on what grounds?
  • I sent a letter off to Barclaycard on the 1st December to ask for a list of any charges from the last 6 years, & I'm yet to hear a reply from them. I know they have 40 days to do this but I was just wondering if, when they do send me the list & I write to them asking for any charges back, can I ask from the 1st December 2003 or can i only ask from 6years previous to the date of the 2nd letter, which would probably be sometime in January 2004?

    Had my first success today. I rang Vanquis credit card about 3 weeks ago and registered my complaint about charges. I never even had to write a letter and today i have received a letter giving me back my charges of £288.00. Only a small amount but its a start.
