#2 Capital One- claimed £733, was offered (and accepted) £642 which was confirmed- this has yet to be deducted from company they sold debt onto in the meantime, who are now chasing.. how do I get rebate taken off?
If they sold the debt to a company then surely the company own the debt? Have Cap One confirmed that they were going to do this?

Have you claimed every single charge back from Co-op since the card was opened?
Do I give the ma final chance to sort (would accept difference in my claim and theirs, if that was the end of it, though would it affect status if I had to take it further- to FOS, or c/court..?0 -
thanks natwest- got letter direct from cap1, sayingthey would get claim amountdeducted by (whoever) debt co.. Lowells i think it is are chasing for full balance, though have yet to prove ownership etc, with CCA etc..
for coop, i claimed the 6 year maximum charges .. may add more interest to date as was quite a while since orig claim.Long time away from MSE, been dealing real life stuff..

Following on from bigger Lloyds success of late last week (£921.00), I recieved notification today that Halifax were paying me £200.00.
This follows writing two letters before recieving a paltry offer of £13.00! Wrote back stating I would not accept this, but would (without prejudice) accept £200.00. Heard nothing so rang them after 14 days and spoke to a very amicable chap who immediately agreed to the mutually acceptable payout.
Thanks again Martin and crew, this is fantastic stuff. Now for Capital One and Shop Direct. :j0 -

morning campers...a month or two ago, the halifax offered me £125 as a goodwill gesture...i had nothing to lose so i told them that the offer was insulting..it took a month longer but i got what i wanted/needed..ok, it aint cash in me hand, but it took my cc balance down to below my limit....that £125 they offered would have just been swallowed up.....

Offer received 21st September of £24
Wrote back 25th September 09 declining
Telephone call from Capital One 1st October offering full amount.
Amount owed: £335 & Interest of £47.19
Amount received £335 & Interest. (Minus £60 they are using to clear my account charges and bring the account to date)
Wow...I seem to be the only one on here that has had luck with Capital One so far as they have been really easy to deal with...in fact...the easiest so far!!!
They owe me £335 plus interest. I wrote to them in July asking for bank statements. After 4 weeks nothing, so I called again and was told they lost my cheque and asked to send another. So sent this recorded. They confirmed they had it and made me an offer of £24.
I wrote back the letter below and low and behold - a week later someone called Melanie called me and advised me that as I had mentioned I was going to the FOS, they are trying not to have any new claims in with them so are happy to offer me the full amount to close the matter. She advised she would send me a letter to confirm that I agree to settle, they will take the £60 odd from the offer money to clear my account and send me the rest in a cheque?
Here is the letter in case any of you wanted to try the same:
[FONT="]I refer to default charges applied to my account amounting £335.19 (£288.00 plus interest of £47.19), which I have requested you pay back. [/FONT]

[FONT="]I wrote to you on 9th September making the original request for a payment in settlement of my claim. As I have received a letter from you but I do not agree with the contents, I am therefore writing to inform you I intend to claim the full amount claimed together with interest up to the date of judgment and court fees in the proceedings through the county court and the Financial Ombudsman Service. [FONT="]I have already submitted my complaint to the FOS who have agreed to take the case on and will be contacting you in the next 30 days to obtain your final offer, if I do not receive it in the meantime. [/FONT]

Wrote to MBNA back in Jan 2009 setting out a claim for a PPI refund in full. MBNA sent a final response letter, so took it to the FOS who just recently ruled in my favour. The whole process took about 10 months from start to finish. Very impressed with FOS kept me informed all the way. Expect these things to take a while as the FOS are getting inundated with complaints - dont let the "final responce" letter put you of taking it to the FOS.

I know this is the thread for success stories and I am not quite at that stage (yet) but looking through I see that Capital One seem to be the most awkward at refunding money-this is who I am trying to reclaim from and it seems to be a fight at every stage! I'm looking to reclaim £175 it's not even a huge amount! Is this going to be a long drawn out process do you think? Won't give up though!
My process was really quick....have you tried calling then? Its so odd how they do one claim really quickly and the other they wont even pay out. Have you tried sending them a strong letter like my one above?0 -
Hi there mantell2005. Could you please tell me which address you used to send the letter to Vanquis? I sent them a letter with a £10 cheuqe requesting a detailed statment of all my charges. I recieved a letter back within a couple of days with my £10 cheque back and the letter said that my case is being investigated and they will keep me up to date with what is happening. Is this similar to what you had?
its not the same as what i had, i only sent the first template letter and immediately received an offer of full repayment.
i would send another letter after 14 days of first letter clearly stating that you want your money back!
so far i havent had a problem with claiming from credit cards, however the £195 from abbey was indeed a goodwill gesture to ease my financial problems, the rest of my claim has been put on hold.
i will be writing again asking for the money as if they are offering me money to ease my finances then they should pay out under the financial hardship rules!0
