    There is still hope when claiming, thought i may have left it too late but sent 1 letter requesting £1100.00 with £368.13 in interest, expecting to get an offer of the differnce between the charge and £12 so i could maybe bargain with them. They signed for my letter this Tuesday and i have received a letter today saying my account will be credited and refunds will be reflected in my next statement.

    After years of minimum payments and he bill still rising i can now pay it off within 12 months.

    I recommend to try the full amount with Barclaycard, you just never know!!! Thanks Martin:T:A

    :) Lloyds win: 1090 (full charges with 8% added)

    I have had two refunds from Lloyds cc now the 1st after letter 1 for 250ish and the 2nd after letter 2 for 840ish. On both I changed the template and asked for the full intrest applied at 26.52% and 8%... they have ony agreed the 8%. Both payments have reached my account and I didn't need to sign anything in the way of a final settlement.

    Lloyds say... "Although we still havent changed our charging policy as a gesture of goodwill bla bla" and then about interest requested "We note that you've asked us to apply interest at the same rate as that charged for your credit card transactions. However, as you may be aware, 8% is the accepted interest rate when addressing complaints such as this. Because of this we do not feel there are any grounds to agree to your request"

    I know they tell fibs but haven't found much info about claiming the intrest that they have added. Matrixds do you think it is worth taking it to the FOS next? as the intrest applied is huge!

    Just wanted to say - don't believe the lies they will tell you. I have just successfully claimed £200 from cap 1, using the on-line court service route (MUCH MUCH quicker than my eventually successful claim against EGG through the Ombudsman.), they rebuked all my letters and wrote to me telling me they were going to defend the court case. A few days later I received the letter saying "as a gesture of goodwill blah blah blah" - full refund of charges and court costs.
    Don't be afraid to use the astonishingly easy on-line court method!

    12th may sent letter asking for charges
    13th june sent letter asking for money back
    28th aug sent letter threatening court action
    26th sep letter recieved apologising and saying that we can have all the money back :j

    Just briefly, i got on the case for my girlfriend to reclaim her charges. The letters recieved at first from virgin said we were not getting the money back.The last letter i sent asked for £200 instead of the full amount (£286.19) so we could sort the issue out quickly. Recieved a letter this morning saying that 'in an effort to maintain our relationship with you' they would arrange a 'goodwill payment of £286.19' to be sent by cheque in next 10 working days. So the perseverence paid off.

    So i would like to say a big thankyou to Martin for the info on this site :T

    The story: Read here, followed the steps, threatened court proceedings and they paid out, why more I don't know, (I'm not complaining)

    ***Hint gossip HBOS is the are going to try going into liquidation and open a new named bank, and not pay anyone - so all claimers try get in now before they get a get out clause***

    It would be the same as if you used an N1 form(which is better if you are going to the court process since it means you can put your case in it much better),

    received cheque for £2,884.50 pence and a letter saying that after the test case they will review to see if I am owed more.

    I claimed hardship with a letter from my Landlord saying I was in arrears.
    Big weight off my shoulders.

    It is in proportion yes. The range is from £25-£75 - but there is an upper limit - £5000 maybe? Follow the link from this site (in the information on reclaiming c/c charges back section) - I honestly couldn't believe how easy it was!

    Capital One
    Claimed £545.70
    Settlement £707.27 (Original settlement £80)

    Went through all the letter stages, got offered £80.00, refused, went to financial ombudsman and have just received a letter from them to ask if I would accept £584 + £123.27 interest. Have sent back acceptance slip and awaiting the credit from Capital One.

    My husband's claim was £593.26 and we were offered the same as above, had to go through same process but they have agreed to refund the full amount. Again we are still awaiting the credit to the account from Capital One.:T
