I am currently making a claim under Section 75 of the Consumer Credit Act 1974 against Alliance & Leicester who I fell are being extremely divisive and evasive. I would like to post the full story but I am unable to find a suitable topic. In short, Alliance and Leicester seem to me to be doing everything in their power to blatantly avoid meeting their legal obligations under Section 75 of the Consumer Credit Act 1974.
A&L have refunded all charges to me (which is what this thread is for and not Section 75 which is on Equal Liability). A&L Credit Cards are issued by MBNA who are a nightmare! My sympathies!0 -
Bank: Capital One
Amount Reclaimed: £488.00 plus £86.54
Amount offered: £56.00 (eventually £488.00 plus £86.54)
The story:
The standard Capital One story:
Wrote letter asking for list of charges
Wrote letter asking for £488.00 + £86.54
Received letter stating charges fair blah blah blah offered 'goodwill gesture' of £56.00 (difference between the £20 and £12 charges - didn't even offer interest!! :mad:)
Wrote another letter saying thank but no thanks - full amount if you please.
Received final offer of £56.00
Went to FOS.
Received letter this morning from FOS stating that Capital One said that - 'as an alternative to our formal investigation' will pay £488.00 + £86.54 interest :j :j

I didn't keep track of the dates but it was probably about 5/6 weeks from sending the letter to the FOS and receiving the full offer.

Have had Several successes due to this site,
MBNA £1700 only took two letters and two months
Capital One £900 Referred to FOS. Cap One were very clever and managed to stall complaint long enough to have it span end of 2008 and start of 2009 so they could write off a full twelve months charges.
Capital One £600 Referred to FOS. Same story as above on stalling.
Most Notable Success Story GEMoney £1700. Seems to have taken forever, they stalled, said they didn't have statements etc, etc. They offered £149 when claim was £500. Referred to FOS and it has taken at least six months but had a phone call yesterday saying they had agreed to refund all charges, interest and an additional £200 (something to do with loss of money? - didn't catch it all on my mobile). Am delighted. FOS are brilliant. Assault on M&S and First Direct about to commence. All thanks to Money Saving Expert.0 -
Had two results recently thanks to this site.MINT reclaimed £500 received £492.48.Only two letters and around three weeks.CAPITAL ONE reclaimed £899.00 received £819.00. Once referred to FOS only around six weeks.None of this possible with out this site many thanks0

PPI complaint
Amount claimed: Unspecified, just asked for a refund.
Amount they paid: £469.89
Sent the template PPI letter from this site to Egg on 3rd June.
Received a letter on 19th June 09 offering a full refund plus interest without further ado, and the refund was credited to my Egg card account straight away.
Account charges complaint
Amount Reclaimed: £408.00 plus £69.03 interest, total £477.03
Their final offer: £8.00
Amount they paid: £404.00 plus £72.84 interest, total £476.84
Wrote my first letter asking for a list of charges on 3rd June, and after requesting a refund, I received an offer of £8 from Egg. It made me wonder if they even read their own letters, since it must have been obvious that I wasn't going to accept that little beauty.
Anyway, after writing again and asking them to reconsider, they sent a "final review and decision" letter, giving me one last chance to accept the £8. Off to the very friendly, helpful and efficient Financial Ombudsman Service.
Received a letter saying that Egg has told the FOS that it would prefer to settle the complaint as an alternative to a formal investigation, and whilst accepting no liability, they have offered me just 19p less than I asked for in the first place. I'm accepting the offer of course. I paid off the balance of my Egg card after selling my house recently, so hopefully I'll just get a cheque in the post for this one.
It just goes to show that these banks are still treating their customers with disdain and only taking a complaint seriously when threatened with a formal investigation.

PPI complaint
Amount claimed: £316.30, plus interest of £64.30, for a total of £380.60.
Their 'final' offer: £166.63
Amount they paid: £333.27
Complaint sent to the FOS on 27th July 09. Rang FOS on 18th September to ask about progress, and the case was still waiting to be assigned to an adjudicator.
I received a letter on Sept 19th direct from Capital One. Even though I'd put the matter in the hands of the Financial Ombudsman Service, they put in one last offer of £333.27. It's £50 less than what I asked for, but it's still £333.27 that I didn't think I was ever going to see again, so I accepted it.
They mentioned in their letter that they would knock the refund off my credit card balance. I paid off and closed this account in February, so I've told them that I'd like a cheque instead.
I've written to both FOS and Capital One saying that I'm accepting the offer, and once the cheque arrives, that's sorted.
Account charges complaint
Amount Claimed: £300 plus with interest totaling £84.84, for a total of £384.84.
Their final offer: £72
Phoned the FOS on 18th September 09 and opened a new complaint. They emailed the complaint form straight away, I signed it and enclosed copies of my complaint and Capital One's final offer.
Provider: Barclaycard
Account charges complaint
Amount Reclaimed: £672.00 plus £171.13 interest, total £843.13
Amount they paid: £843.13
Subject Access Request asking for a list of charges sent on 7th September 09. Received statements going back six years on October 2nd. Was surprised to see that there are charges totalling a whopping £672. After adding interest, I've asked them to refund £843.13.
9th October 09 - just looked online and they have refunded the full £843.13 to my Barclaycard account - only four days after I posted the letter asking for the refund!
There was a zero balance on my account before the refund, so I now have a £843.13 positive balance. Terrific that they've paid up so quickly and with no messing around.
I rang them to ask how best to get at the refund money. I sugested that I could withdraw it using a cash machine, but apparently all cash withdrawals are set against your credit limit regardless of whether your balance is in credit, so if I'd done that I would have been charged interest, despite having a positive balance.
They're transferring the positive balance into my bank account and they say it should take four of five working days. Barclaycard are by far the most reasonable with this stuff, apparently they're the only ones who realise that when they receive a MSE template letter, it means that it'll go to the FOS if they don't refund.
Got to respect Barclaycard for having the sense to avoid all those investigations and saving themselves the admin costs of firing letters back and forth with derisory offers and refusals like some of the others have.
