    Having used the template letter on this site to request details of my charges, I used the interest calculator to work out a total of all the money I was owed including interest over the last six years.

    I sent the letter asking for a full repayment last weekend and today I received a letter from Barclaycard, saying that as a "gesture of goodwill" they will credit the total amount including interest to my account!

    Amount received: £1798 + £247

    Received after 2 letters.First received £247 being the difference between £12 and £20. Said this wasn't acceptable snd asked for a full refund including contractual and 8% interest. To my surprise received a letter this morning sayiing they giving a further refund of £1798 which clears my balance and they will refund the small difference in the next 10 days. Hooray!!

    I've started the process with this monstrous company. Been with them about 6+ years and have been ripped off to high heaven.

    My AGREED LIMIT was £1,700. My balance reached £2,500 and I just could not get it to go down!!!! And this was only from fees. I hadn't used the card myself in about 4-5 years!

    I'm also going to try to claim the "Payment Break Plan" payments too. I've read that they told someone it isn't PPI, and I've also read that people feel it cannot be claimed back. But on several occasions I tried to use it and was denied! Why was even paying for it when they wouldn't let me use it!? Then as a result of them denying me use of my "Payment Break Plan", I incurred more late fees and over limit fees!! And so the cycle continued!

    Sent the request around 22nd July and recieved them 4th Sept. The letter they sent along with the fee's also stated this that and the other about their terms and conditions and that they feel their fees are fair and legal. I guess they already know what's coming!! lol

    What annoys me the most is that in 2004 I had not one single late/over limit fee as I was close to paying it off... then life's circumstances maxed the card over a few months back in 2005 and I'm still paying for it big time! Limit was £1,700 and must have paid them at least £6,000+ over the years simply because of their fees and fraud.... sickening!

    Trying to go back for difference between 8% interest i asked for and the 27.9% they have charged me!

    THE STORY: Requested statements took full 40 days to arrive sent 2nd letter asking for refund letter received back 6 days later, admitting no liability but as offer of goodwill will refund full amount requested.
    THANKS TO EVERYONE ON THE FORUM FOR HELP AND ADVICE.
    Now waiting for marbles to reply before attacking ppi charges on first direct loan, barclaycard and marbles.
  • I am currently making a claim under Section 75 of the Consumer Credit Act 1974 against Alliance & Leicester who I fell are being extremely divisive and evasive. I would like to post the full story but I am unable to find a suitable topic. In short, Alliance and Leicester seem to me to be doing everything in their power to blatantly avoid meeting their legal obligations under Section 75 of the Consumer Credit Act 1974.

    I started this process against Egg back in March, and had to wait almost 3 months for my statements. Followed the advice on this site (THANKS TO ALL HERE BTW!!) and received Egg's final reply to my letter threatening court action basically saying - The OFT have agreed our £16 charges so go whine to the ombudsman if you want, you wont get anywhere!
    Rang the ombudsman in June, got a ref number and filled in the form on line. They contacted me a month later saying they are really busy but will deal with my claim within 2 or 3 months.
    Today I received a letter from them stating that EGG do not accept the unfair nature blah blah blah, but as an alternative to the Ombudsman's formal investigation would like to offer a full refund of charges plus interest!

    EGG have been PARTICULARLY unhelpful and intimidatory and I fully expected the Ombudsman to side with them - but they didn't! STICK WITH IT PEEPS - it really is our money NOT theirs and they have no right to take it!!

    Successful claims to date: RBS £280.00 (no ombudsman or court action needed)
    EGG £190 - 6 months but the Ombudsman rocks!
    CAP 1 £200- they have until the 26th September to reply to my court summons.

    They charged me 27.9% rather than 8% so worth a try!!
    Amount received: The full amount asked £839.89
    Was amazingly quick.

    Had another Barclaycard and already received £861.67 last month but that included interest at 8% so i have gone back and asked them for the difference between the two rates - worth a try! who knows!
