  • Hi,

    New to the boards, just a quick question. Im in the process of reclaiming these charges from 3 credit cards. Without pushing my luck, can anybody tell me whether i can reclaim 'charges' from when I withdrew cash on my credit cards? Stupid i know but yes, i used to do it!!!

    Thanks

    Barclaycard = £301.60 includes 8% interest
    Barclaycard = £300.32 includes 8% interest

    Went on forum couple of weeks ago and thought Id have a go!! I keep all my statements so I decided to dig them out and add the charges up. Sent 1st letter requesting full amount plus interest. It has been less than two weeks and have had a reply, telling me they are going to refund full amount plus interest. As the accounts have been closed for years, I have replied saying that I accept and details of my bank account for them to process refund.

    Big thank :rotfl: you to everyone as I didn't hold much hope, but was so easy!!

    I am now going to try on the others Marbles, Halifax and A&L

    barclaycard - 1,300 (settled against account balance so i now owe them 00.00!!!!!)
    Marbles- 1050.00 (account settled a few years back so a nice cheque for me!!!)

    both refunded after first letter- no hassle at all. still waiting for reply from Capital One who I sense may be less willing to refund.

    Thanks everyone.

    I doubt it, whole different ball game Im afraid.

    However that being said, you could still argue with the bank and complain that you dont believe the fee reflects the true cost to their company and therefore is NOT fair fee. (only a Court can state what a FAIR fee can be)

    Be warned though I doubt this will result in success and you may end up going the distance to Court to put forward your case so your paperwork and arguement will need to be 100%.

    Hey worth a shot though, you never know.

    Good luck and keep us posted if you do.

    Hi,

    I have posted this on the discussion thread but am also posting it here as it is also a partial success story.

    My partner put in a claim to HBOS for CC charges and HBOS wrote back offering, in settlement, the "£12 fair charge" offer (ie, what she claimed less a figure of £12 for each charge, stating that £12 was reasonable). :beer:
    The difference is about £500 so she wants to go for the whole amount and will issue court proceedings but, in the meantime, 5 of the charges she claimed in her original letter now fall outside the 6 year period (2 in May 2003, 2 on June 2003 and 1 in July 2003).

    Is she stopped from claiming those five charges now or does the six year period run back from when she first made the claim, in writing, to the CC company?

    Thanks in advance.

    Strictly speaking it's 6 years from the issue of the court claim. However I'd still include those charges. Worst scenario is HBOS will merely refuse to pay those falling outside the 6 year period, but even without them you'll be £400ish better off, plus you can claim s69 8% interest on all the charges.

    If, therefore, the time between the "first" and "second" letters we should send to the card providers would cause you to miss out on reclaiming some charges because of the six year rule, is there anything to stop a person simply working out the loss and beginning a court action without giving the card providers time to settle the claim? (Sorry for the long sentence) :o
  • hi guys. Just had a first response from hsbc. Im a little confused because they think im only owed £24. I wonder if theyve 'forgotten' about something .. U know how they are!
