  • Thanks, one further question, will he be able to get the credit card company to send either the last 6 years of statements or list of charges now that his account has been closed for over a year, maybe they won't be too helpful, can they be forced to provide this information, or can they hide behind any law?

    Try not to be scared. Its all just a tactic used by the financial provider. Have a read and familiarise yourself with the MCOL route. Its painless and relatively quite userfriendly.

    Do not give up. Thats just what they want you to do.

    In short YES. The financial company are obliged to keep details for 6 years. If you have look elsewhere on this thread you will find many others in the same position who have successfully reclaimed.

    Printed Template letter requesting list of charges on 26th May 09. They took the full 40 days to send me the data. Sent second letter asking for a refund of charges on 8th of July. Received their final offer of the full amount I requested including 8% interest today 21st of July. Result!! :j

    Easy, 2 stamps and over £500 up - Thank you Martin and all moneysavers who keep this forum alive - Brilliant!!! :rotfl:

  • is the claim start period of the 6yrs from July 2001?
  • I have 6 credit cards namely MBNA, RBS, Mint, Lloyds, Halifax and BOS - dont ask! Had my silly headon!

    Anyway I was thinking about trying to claim back all the charges and defaults placed on the cards since I took them out.

    Do I just use the template letters and send this to each of them asking for a list of the charges etc on my account since I started the card.

    I am trying anything just now - all of them are being managed by a DMP and I pay a meagre amount per month and if I was successful I can at least reduce my debt by alot.

    Also have some PPI cases with WF, FP and Halifax. So if I get those back too will possibly half my debt amount which would be great and make me feel like I am not as bad as I thought I was. Also would save us masses of money and we could use it to pay off more. Just want to be debt free bfore I hit 50! lol I will be 40 next year and this wasnt how I had hoped to spend my birthday - depressed and skint.

    I enjoy reading everyone's successes on the boards it fills me with a lot of hope and makes me smile.

    I have received a reply from Egg today in response to my claim. I sent the 1st template letter on the 8th of July requesting that they repay the difference between what they have charged me and the £12 suggested by the FOS. So they have been pretty quick at responding!
    They have offered to repay the difference between their £20 charges before Aug 2006 and their current charges of £16. So, only £4 instead of the 8 that I believed they owed me. I want to continue the fight and send a second letter requesting that they pay the full difference and add the interest that I had originally requested, rather than the basic £4 on offer with no interest.
    I wonder if anyone can help, they claim...
    “The OFT stated that the presumption of unfairness in relation to charges over £12.00 would not apply where there are exceptional business factors. They therefore acknowledged that in those circumstances, a card issuer may be able to set a fair default charge above the £12.00 threshold.
    The OFT, as an example specifically referred to Egg’s practices of requiring all customers to pay the minimum monthly payment by direct debit. Following the conclusion of the investigation, the OFT indicated that it would not proceed further against Egg on the basis that Egg reduced its charges from £20.00 to £16.00. Accordingly, without any admission of liability as to the previous level of charges, Egg reduced its default charges to £16.00. The OFT has taken no further action against Egg.”
    Does this mean that I am unlikely to win if I send this complaint to the FOS?
    Also does this mean that Egg has been approved to charge £16, so I am wasting my time trying to get them to refund the difference between the charges and £12?

    Ignore them. This is exactly the same letter I've just had from them & it's probably the same letter everyone else has had. Keep going to get your money back, dont let them try to frighten or bully you into accepting less.

    Received a letter today from Barclaycard in reply to my first letter downloaded from this website.

    Barclaycard have confirmed that they are going to refund all my charges in full including interest at 8%.

    Very impressed.

    Just waiting on Egg, have downloaded 2nd letter and send off, HBOS sent 1st letter off, still waiting on statements from LLoyds and capital one!!!
