    Hi there, hope someone can help.

    If after 2006 the credit card only charged £12.00 everytime can anything be claimed?

    I have a balance with barclaycard (in a DMP) all interest charges etc stopped. I have done my letter for £13.00 rather than the £25.00 (it seems you have more chance this way) ???

    But have only gone up to the point they charged £25.00 not when it started to be added at £12.00.

    Does anyone know if this is correct ?

    Also do you have to know what they owe, or can you just ask for the charges back ? I have 3 credit cards I would like to try getting PPI back and unfair charges. I have firstly asked for a breakdown of all charges.

    I have looked on lots of posts but seem to be getting a bit muddled !

    As far as I know, the 12 pound charge was only recommended by the OFT to banks/credit card companies, April 2006 - but it is not a legal charge.

    The only body who can enforce a legal charge, is a court.
    Quote the OFT report: OFT842 in your correspondence, which makes this clear.

    You can claim back the full amount, but it will probably take longer. Claim back the difference and you'll receive a quick settlement. I got a quick settlement from Cap. One. As I've applied for my PPI charges - which are phenonminmal, I decided to reclaim the difference, re: credit card charges.

    Go for a 100% reclaim.

    recieved a offer from lloyds for just under £200 for cc charges

    original claim was for £600 so i have sent the second template letter for the rest...

  • i'm new to the forum so go easy on me?! last year i got about £500 from HSBC for bank charges and now have just realised i can re-claim credit card charges!

    i have 2 years worth of statements from Barclaycard which i've counted up and it comes to £560 - they say the other statements are on microfiche but doesnt mention if i have to pay for them? So i have a few questions ..

    On the Barclaycard card i've had a proper nightmare - the limit was £500 but as they piled their charges on it went up to about £700 after years of paying them £50 here and there and the balance never coming down i gave up and went with the CCCS who put me on a debt management plan Barclaycard have been recieving lower payments from me now for about 18months .. :D

    Questions:

    1. Can i still claim for these charges even though i am with CCCS?
    2. If they agree to payout does it have to go onto the credit card which i don't even have anymore and the last time i used it was 2003?
    3.Can i ask for a cheque or for it to be paid into my normal bank account?
    4. Should i ask for all 6 years' statements? i personally would be happy with £500 back from them...

    Hi,

    1, Yes definately you can still claim regardless of the fact that you with CCCS.
    2, Any refund of charges that you may be awarded Im afraid will be offset against the outstanding debt first, then if any left over will be paid by way of a cheque.
    3, If number 2, happens then Yes you could request that be paid directly into your bank account, although my advice would be to request a cheque though.
    4, Finally and probably most importantly Yes definately request the full 6 years. Any charges you have in this period are potentially unlawful.

    Barclaycard have sent me the letter asking for the £10, but I see some people just ask for the charges back without knowing the value ?

    Is this advisable ? Or should I add everything up from the statements when paid the £10 ?

    Is there a template letter asking for the charges when you don't know how much?

    They have paid it off the debt I have with them via Debt Collectors.

    Provider: GE Money (Dorothy Perkins Account Card)
    Amount They Paid: £33

    Few letters back and forth, they have now agreed to pay by cheque - still waiting to receive.

    Provider: Egg
    Amount Claiming: ???

    They are being super difficult and still awaiting statements!

    They offered me £44.00 - I sent letter saying no thanks wanted the full amount and got a letter yesterday saying they going to pay full amount.

    Don't give up and keep sending letters to chase them and they do pay up in the end. Moving onto my hubbies credit cards now.

    Story to date
    17/2/09 requested list of charges
    2/4 sent letter requesting full amount of £500(no interest)
    23/4 received offer of £178 (amount over £12)
    23/4 rejected offer
    5/5 sent form to FOS requesting £668(incl interest)
    Since then had various letters from FOS saying they are dealing with the case
    Today received letter from FOS that although Cap 1 feel their charges are fair blah blah it will settle and offered £480 + £160 interest.
    Therefore they are offering £640 which I am accepting

  • hi just a big big thank you for your help we had a successful claim to refund aprox £1500 from barclays for charges from former woolwich bldng soc .we used your hardship template to claim .they took out money to clear our overdraft and the remainder was put in our account brilliant one less debt to worry about, to anyone thinking of claiming its your cash dont hesitate do it now!!!!
