    I'm just querying because i'm tempted to claim my charges back but am on an IVA so they will probably just credit the debt that is outstanding on my card, which wont really be any use to me short-term.

    just a quickie - they cant do that - they have agreed your IVA terms, and to pay the moeny to themselves is breaking the legal thingy... Speak to your IVA provider and get them to contact the company,the money is yours (well - its classsed as a windfall, so you have to give them half, but thats normal!) and the IVA company can get them to pay you. ( Ive just had this conversation with my IVA provider,who have basically said its less than 500,so were not interested in it, but that money is yours,not Eggs,so leave it to them and they willl get me a cheque!!)

    Ive just had the first letter (the we'll refund you the difference between your fines and the £12 one) from Alliance and Leicester - as they are mbna Im writing back with exactly the same letter I used on mbna (when the first cheque turns up!!) and am expecting to get the whole amount.

    I really cant thank everyone involved with this enough - Id never have had the guts to stand up for myself without this place.

    Who is your IVA with as i got charges refunded from the Co-op and Smile (£320 and £338 respectively) and they've not refunded the money to me but claim the charges were already refunded as part of my IVA terms and conditions, which i thought wasn't right at the time.

    Technically i should be entitled to keep these refunds as my IVA provider states that anything over £500 is classed as a windfall and that 50% of it should be paid to the IVA. If i had received two different cheques then i legally should be entitled to every penny.

    These banks think they can do what they want!!

    I'm going to write back stating what you've said and see what happens.

    HI Clanger (by the way - you were my favourites when I was little - you and the flumps!!) Im with Blair Endersby. They have been nothing but helpful for me, and the first thing the lad told me when I queried wether or not they can pay it back to themselves was "they cant do that - that money is yours!!!!"
    It was him who said to leave it with them and he would set my account manager on them.... We shall see!!

    Best of luck with them - but I really would contact your provider first - its all to do with the legally binding stuff that they and you have signed up to, so Id not get involved after telling the IVA people !!!!

    Thankyou for the info on the cheques - I didnt know that all the accounts are classed as seperate payments - if all goes to plan I am hoping for in the region of 1500 - 2K back from various sources - and fully expecting my next years payments to have to include half - that would be one heck of a bonus !!!!

    This has taken 2 letters and about a month-6 weeks. They made an initial offer of £90 which I refused, and today received a letter to say they will pay the whole amount. As the card debt was sold on, I won't actually get the money, it will go to the people who the debt was sold on to. But in my eyes a victory is a victory.
    Thanks Martin and your team-without the template letters and all the info available, I wouldn't have done it. :beer:

    Wrote both first & second letters with absolutely no response whatsoever. (Hint: Make sure you send things by recorded mail - that way you can be sure that they've received your letters when they don't respond.) "Charming", I thought :confused: - off to court I go (I did it online using Moneyclaim).

    They put in a court defense. I would have buckled then but I've dealt with bigger and better so I thought, "Bring it on". The court sent me some documentation that I didn't really understand but then their solicitors asked me for a list of charges. By that time, even though I was claiming over a thousand pounds, they would only pay for the last 6 years. I'm out of work right now so I agreed to it.

    By the way, they asked me to sign that I keep the claim and payment confidential. Flaming cheek - :mad: ! (Does anyone know if they're allowed to do this?)

    So, even though I'm running late, I'm going to post this information BEFORE I sign to THAT agreement.:wink: Let's see how they'll trace me from this.
  • Hi, good news folks, I got The Abbey to cough up in excess of £3,000 for bank charges. I claimed financial hardship and they moved pretty swiftly. The downside is..... they decided that they were going to use the money to partly pay off my loan which is already on a debt management scheme.....ho-hum, but at least it's a whopping amount off what I owe so I shall be free of debt much sooner!
    I just hope that The Cooperative Bank cooperate in a similar fashion.

    The Story: Just took the persistence to keep writing. After sending 3 letters and ignoring their stupid legal arguments they sent back we got 100% of what we asked for.

    Just go for it!!!

    Total amount refunded after around a two year, non stop battle - £3,500

    Keep going at them, call everyday, send non stop letters and copy them to as many head offices/branches/OFT as you can!

    Eventually they will cave and you will get all your cash back!

    Just followed the instructions on this site and claimed for all charges and interest. MBNA made an initial payment of the charges, then paid the interest too after I put a bit of pressure on. All in all, I found it a really straightforward process, thanks in no small part to the excellent advice on this site and the forums.
