The story: After just one letter they made the offer stating that while they 'don't agree with the analysis of default fees in the OFT statement in April 2006, as a gesture of goodwill we would like to offer a payment of £299.00. This offer is equal to the difference between the amount you were originally charged and £12'.
While I'm ordinarily a 'don't accept the first offer' kinda gal, I'm too busy to mess about at the moment, and for the sake of one letter, I'm £299 closer to being debt-free with minimal effort involved, so happy days! I now need to work out exactly how the money will be deposited as the account is dormant and being 'looked after' by a collections agency.

All I had to do was write the first letter and within 3 weeks I recieved an offer letter of £198. Considering I only claimed for £172.14. Crazy I know but Im very happy!:j

I wrote the first letter and recieved a reply stating that my complaint would be dealt with within 4 weeks. After the 4 weeks I recieved a offer of £128 and told the cheque will be with me within 10 days. Now after reading other peoples posts on this forum and their success with MBNA I have wrote the second letter requesting the difference between my claim and the partial offer they are paying me. Fingers crossed!

Sent the first letter 25/1/08 - requesting refund.
Received letter 30/1/08 - Standard acknowledgement.
Received letter 18/2/08 - offer £31.97 being difference.
Called on 19/2/08 - error made by creation - missed £8 in calculation! This was verbally added to initial offer. Said I was not happy about the level of the offer, and was 'encouraged' to write in with second letter!;)

Called Barclaycard customer services no joy as to why the difference those in Indian call centre veryand could only read from screen. Wouldn't give me a contact number for Northampton to call on Monday:wall::mad:
Have worked-out I have been refunded the total of all charges + 8% interest, not from when the charge was made, but on the total, i.e. Visa total charges £160 + £12.80 interest (being 8% of £160). Not what I asked for, but hey better that a poke in the eye with a sharp stick!!!

Asked nicely for refund using the templates off this site 10.3.08
Got a polite 'not a hope' letter from them 26.2.08 offering £88 final offer!!
Sent the template letter saying 14 days or I'll take you to court 2.3.08
Another letter from Capital One saying they wouldn't back down, take the £88 and don't bother wasting the court's time 8.3.08
Filed for court using MCOL 8.3.08
They acknowledged saying they were going to defend then got a lovely letter this morning (5.4.08) saying my account has been credited the full amount as a 'goodwill gesture' but not accepting fault :rotfl: But since my account's been paid off in full since Feb, there's a cheque in the post within 21 days!!

The Story: I wrote to them on behalf of my wife, requesting a full refund. They kept wrote back saying that as goodwill they would return about £500. So we took them to court. They acknowledged the claim and they had up until Monday before we put in a judgment against them. Saturday (2 days earlier) we got a letter saying that out of good will, they have refunded the whole amount to the card and will send us a cheque for the balance. Don't be afraid, people! We are just ordinary people that know how to use the internet and post letters, just like you. You can do it too!0 -

They did not want to be investigated by the Ombudsman!!

letter from FOS 28 Mar 08. Egg don't want to make another offer. so FOS will be asking them to make a revised offer or provide info that we need to reach a conclusion on the merits of my claim.
8th April letter from FOS egg prefer to settle my claim as an alternative to their formal investigation. they still say they don't accept their charges are unlawful or unfair!!

Timeline - 17 March sent letter to BC special delivery requesting refund of all charges plus interest for both cards. Reply requested within 14 days. No response received so on 1st April rang Customer Relations (08445560104) and registered complaint with them. Followed up on 2nd April with another special delivery letter giving 14 days before I commenced court action. On 4 April a refund of £252 + £20.16 interest was applied to my Visa card. Still no letter as yet but when I checked online this morning another £475.20 credit has been applied to my account! As yet nothing on the Mastercard however I will pursue them for the full payment on this account as well as the last £156.76 on the Visa!
A note to anyone living in Scotland - ask for the full six years worth of charges instead of the Scottish five years, they will probably pay them anyway and you can always drop a year if need be. I was in the fortunate position of having an English postal adress to use if I had needed to go down the court route but it would appear that Barclaycard are now trying to settle as many cases as possible before this becomes necessary!
Anyway at minimal cost I now have a positive balance on my Visa card so thanks to all those who have posted before and led the way. Next stop - reclaiming £2450 from Natwest in bank charges, just a pity things are on hold at the moment but hey, the interest on that sum is going up daily!0 -
