    1st letter sent 30/10/07 asking for charges totaling £588 to be paid back
    letter back 02/11/07 NO
    2nd letter sent 05/11/07 threatening court
    letter back 07/11/07 goodwil payment of £295 which I accepted. very naive this was my first try sending letters from the templates found on this site. At the time I was overjoyed to get back £295 which had only taken 2 letters and 2 stamps . wow

    1st letter sent 30/10/07
    didn't recieve or hear anything
    2nd letter set 04/12/07
    letter back will respond by 01/03/08 !!
    letter back 20/12/07 offer goodwill payment £302 difference of £12 fee paid back into account
    3rd letter 16/01/08 sent without prejudice accept that but wanted the rest, threatened court
    06/02/08 full amount to be paid into account which i was satisfied with as i had been struggling and had been on a payment plan. so i can now see myself paying this of much sooner. YIPPEE!!!

    JUST WRITE THEM LETTERS ALL TAKEN FROM THE TEMPLATES.DON'T BE PUT OFF BY THE SNOTTY LETTERS YOU MIGHT GET!!!
  • Wrote to Monument on 6th Feb requesting list of charges - received all the info I requested and they sent my £10.00 cheque back too!!
    Wrote back to them claiming £348.00 + interest, received letter back today with an offer of £348.00 (not the interest) Gladly accepted, I didn't think it would be that quick or easy. Very nice letter back from Monument aswell.

    This unexpected windfall is paying for a birthday treat to Barcelona :beer:

    Just a quick note to say that they tried to stall and put me off at all stages, I turned down the offer of a refund of the difference over £12. I then submitted a claim through the MCOL website, and was worried when they entered a defence. However, a few days later I received a letter refunding the full amount so keep at it!!
  • Hi all I have just succesfully :T (and rather easily) managed to reclaim £310 from Barclaycard, £596 from MBNA Europe and am awaitind desicion from Capital one.

    I had all statements to hand so did not need to ask for a copy of these (so saved a tenner already), sent off initial letters using template and the interest calculator ( I went for an all or nothing approach). Had letters back witin 10 days saying the usual; "we disagree with the OFT", "Charges are fair", "YOu signed a contract" BLah Blah Blah- " however as a matter of good will we have sent a cheque for X amount".

    Now this amount was the difference from there charge and the new OFT reccommened £12. I pushed on further using next template and today and letters from Barclay Card and MBNA saying that they are sorry i dont accept there offer and then the usual stuff again... (I thought i had lost it all), till at the very bottom i noticed another "Goodwill" offer, this time for the full amount and that they now consider the matter closed. Im so happy, it has all been dealt with in a matter of 30 days.
    SO do not threat, push them hard, dont be fobbed off... What have you got to loose.

    p.s forgot to mention that all my credit card accounts were closed by me before i started to claim and i did not find this a hinderance at all.

    I cannot believe how easy it was. I would encourage everyone to do it!

    20 Feb 2008 - Statements received.
    20 Feb 2008 - Requested the difference in charges (without interest).
    01 Mar 2008 - Received statement showing a refund of £142.56 (which includes interest).

    I'm very happy with both my recent refunds. :T:T

    The story: Wrote asking for charges applied to accounts, filled the appropiate template letters in, 1st offer of £534 ( the difference ) between £12 and the actual charges, then a second offer of £1146 + £334.85 interest, happy to accept this offer, quite an easy process really, took about 2 months from start to finish.

    I requested copies of my Lloyds TSB statements from three years ago and after two weeks still had not received a reply so I sent another copy recorded delivery.

    Had a reply stating that even after extensive search they could not locate my statements and needed more info. I then telephoned them and told them that by law they had to keep records for six years and as such they must have records there.

    Late on a Saturday evening i then sent another letter with a copy of one credit card statement that i had found with all the credit card details on it.

    The following Tuesday i received a letter that said even with the additional info and an extensive search they could not locate my statements. As they could only have received the letter on Monday and sent a reply the same day I did not think that they could have done such a search.

    I phoned the credit card dept again and complained that the two letters i had were just to fob me off and demanded to speak to someone with more authority. I was finally put through to the supervisor who said that she would look into my case. Within a couple of days I received my statements free of charge.

    I then followed the reclaim procedure using Martins templates requesting a refund of my £332 charges plus £116 interest = £448

    I received the same reply as the one above saying they could not refund as they felt charges were reasonable. I sent a further letter as Martin suggests saying that I intended to take the matter further if i did not receive a satisfactory response.

    I have today received an offer of a goodwill gesture, despite their insistance that they still feel they are in the right for £413!!!!! (total charges plus interest at bank base rate plus a further 14 days interest to cover time for me to make my decision!!!!!):T :beer:

    it can be done im on a dmp and ive got most of mine back just waiting on one more then ive got all mine back.

    abbey 1 claimed £438.12 recieved £440.44
    abbey 2 claimed 896.08 offered £247.00 which ive declined
