The story:
Sent a letter in the first instance to claim the full amount back, they replied with difference of charges which amounted to 64 pounds.
I sent a second letter for the full amount with a threat to take them to court, I have just got a reply back today with the full amount credited plus interest!0 -
Im a new member to this site and delighted with all the info available.
I requested a list of charges which amounted to £220. In the same letter I was offered a total refund!

PROVIDER: Barclaycard

THE STORY:
I used Martin's process to put the claim in with interest and although they offered less than I claimed, I deemed it a good return. Barclaycard provided my statements promptly and also responded to my claim very quickly. As these card accounts are now closed, the money was credited to my account in three working days.
Currently pursuing Monument which doesn't seem to understand the request!

Just to say thanks to Martin et al for the great tips on reclaiming credit card charges - have had success with current account reclaims but didn't realise credit cards fall outside the OFT test case - the banks kept quiet about that!
Story: a 4 month process including letters:
1st letter - refused to pay
2nd letter threatening court action - refused to pay
Issued proceedings for full amount - lodged a defence
Shortly therefater EGG's lawyers telephoned to offer full refund.
They were actually very keen to settle and were actually really nice to deal with.
Now taking Nationwide Credit Card to court - will keep you posted!

PROVIDER: Capital One
AMOUNT RECLAIMED: £1292 + £382 interest
AMOUNTH PAID: £1802 - perhaps i missed a couple!!!
THE STORY: I wanted to get this over and done with really quick so i sent the first letter - they cam back and offered £302, sent second letter and they wouldnt budge. Filed MCOL on the 17th of Jan, they defended and today payed me the full wack.
Now im off to buy me a 50" Plasma and a new iron for the misses!0 -

Amount Reclaimed: 300GBP plus interest
Amount they paid: 429.43GBP
The story: They filed they intended to defend the claim but didn't . So entered judgement. That was 25th Jan cheque received today 7th Feb. Easy!

Bank - Capital One
Amount claimed - £664 plus £171.11 interest
Amount paid - £688 plus £208.88 interest
Story:
I sent a request for 6 years statements Oct '07.
Received statements and wrote letter reclaiming charges of £664 and interest of £171.11 Nov '07
Received reply from Capital One mid-Nov offering total £264 as good will gesture.
Sent 2 letters declining offer but said I would accept refund of charges without interest if the matter was settled within 14 days.
Capital One responded, making it clear that they wouldn't up their initial offer.
Wrote to FOS in Dec '07.
FOS wrote today saying that Capital One have agreed to settle in full!!
Will accept offer as it pays off my outstanding balance. Card will then be cut up into tiny pieces.

Amount Reclaimed: £192 + £8.95 interest at 8% = £200.95
Amount they paid: Full amount claimed = £200.95
The story:
All my charges are post April 2006 when the reduced charge of £16 was in place. I've also received the letter to say they are ending my account before they received my first claim letter.
30 Jan: Letter 1 sent requesting refund of all charges plus interest
6 Feb: Letter received saying no way our charges are fair and that cos of our exceptional business factors the OFT said we may be able to set a fair default charge above the £12 threshold.
6 Feb: Letter 2 sent threatening court action. Also included the following quoted from OFT website:
"As I am sure you are aware, the Office of Fair Trading also stated in its April 2006 statement into credit card charges that where there are exceptional business factors, so that the presumption that a default charge over £12 is unfair is not applicable, this does not necessarily mean that the current level of the default charge is consistent with the OFT's interpretation of the requirements of unfair contract terms legislation."
12 Feb: Success!!! Letter received saying ok you can have the money and it's credited to my account

Jan 10th. Sent letter asking for list of charges
Jan 18th. Recieved charges
Jan 18th. Sent letter asking for £171.00 plus 8% interest (£223.04)
Feb 5th . Recieved offer letter for £55.08
Feb 5th . Sent letter threatening Ombudsman action, or a settlement of charges without the interest, so a new total of £171.00
Feb 11th. Received letter saying they were still right, but as a goodwill gesture, they would refund me £184.68 which was credited to my account on the same day.
Still waiting for a response from MBNA (£903.71) and still awaiting statements from Marbles.0 -

The story
Wrote asking for Last 6 yrs statements , sent off Template Letters ,got runaround ie - only pay difference between £12 / £20 :mad: Sent letter saying thanks but no thanks ! Got their letter saying its our final offer - Took it to County Court ,started proceedings 22nd Jan , recieved a letter this morning stateing ,Dont want to go to court ,we dont accept liabillity, but we are sending you a Cheque for FULL amount :j :j :j :j
