    Hi This Is My First Post So Please Bear With Me, I Made My Claim About Four Months Ago, Got A Reply Saying They Were Within Thier Rights Then A Second Offer Of £425. I Phoned Benificial And Said I Wanted It Passed To The Ombudsman Then Received A Letter Offering £1507 Was Gobsmacked To Say The Least Must Have Had My Figures Wrong Somewhere, Blance Is NOW Paid Off Credit Card Cancelled

    Requested statements 18/10/07- sent £10, which was returned as a goodwill gesture, which appears to be the standard phrase in every letter.

    5/11/07 - sent 1st letter & received a cheque for £279.

    10/12/07 - Sent 2nd letter which included court action. Received a letter stating this was their final response and will not enter into further correspondence unless instructed to do so by the FOS.

    1 week later received a cheque for £121.

    Happy with the amount - better than nothing!

    For all those requesting charges, keep going, you'll get there in the end, and good luck!

    The story:

    Sent my first letter end of Sept. They sent the information and I sent my complaint letter mid Oct. After 3 letters, they have agreed to £421 which I am going to accept (it's not including 8% interest - but I'm happy -still pursuing the PPI though!)
    So that's Egg (£500ish) & LTSB paid up, 2 offers from GE Money of £90 for Kwikfit card and £42 for debenhams (I have cheque)- which I am continuing to pursue.:T :j :T

    Also gone to FOS with PPI claims for Egg Loan & GE Money!:D

    Here is the detail behind my £2,820 claims<O:p</O:p

    Provider: Marbles
    Amount Reclaimed: £450 charged
    Amount they paid: £370
    The story: Asked for 75% of total charges + 4½% interest (as I have with all claims) pointed out that this was cheaper than the court would award (being 100% + Interest @ 8% + Court Costs) and they paid out! It really was that simple!<O:p</O:p

    Provider: IKEA (Store Card) - yes you can get their charges back too!
    Amount Reclaimed: £120 charged
    Amount they paid: £175
    The story: As above, I asked for the 75% + 4½% interest, they failed to respond so started court proceedings - dead easy on www.moneyclaim.gov.uk As soon as they got notice from the court, they paid out in full (100% charges + 8% interest + Court Costs)<O:p</O:p

    Amount they paid: £1489.03
    The story: Again I asked for 75% of charges + 4½% interest but they only offer £303. I gave them notice of the court proceedings and even started them BUT when I told them that I would not accept anything less than 100% of charges + 8% interest + charges and I also point out that I would be requesting the court to award me a further £280 as a "Self-Litigation fee", they offered me £1489.03.<O:p</O:p

    Provider: Barclaycard
    Amount Reclaimed: £580 charged
    Amount they paid: £786.12
    The story: As with all the claims, my initial request was for 75% of charges + 4½% interest. They offered me £244 and even credited it to my account (which has been closed for at least 2 years). I turned down the offer and put it with the court on www.moneyclaim.gov.uk. MCOL wrote and told me that all Bank Charges Claims were on hold pending the High Court Case. I wrote back and pointed out it was not for Bank Charges per se but for Credit Card Charges and they passed it to my local court. My local court also wrote to me and told me that all Bank Charge Claims were on hold till after the High Court Case was over. I wrote back and told them that it was not for Bank Charges but for Credit Card Charges and that I fully expected Barclaycard to pay out in full before we got to a hearing. They wrote back and told me I'd have to fill out the correct form to amend the details! In the mean time Barclaycard wrote and offered the full amount + interest + court costs.<O:p</O:p

    All the above accounts had been closed for at least 2 years and had even gone out to debt collectors for collection. When I cleared the debts I even took discounts ie they offered me £500 if I settled the account in full. This redemption figure was not included in my claims - ie I didn't have to pay it back ;) Capital One wrote to me recently asking for the payment that had bounced in 2006 but I pointed out it was a redemption bonus offered to me and not a payment, bounced or otherwise, they have not asked again :)<O:p</O:p

    Also I am still paying off one of the cards mentioned above on an interest free loan from the card company! Again this did not affect my claim and I still have the interest free loan, which I have not been asked to pay back ;)<O:p</O:p

    Story:

    I requested my statements and waited a month or two, they sent in two lots as some were on microfilm. No charge for this £10 cheque back
    9 June -Sent my 1st letter
    18 June - Received an offer £181
    2 July - Wrote back saying unsatisfactory July
    10 July received letter saying no
    16 July received reply from ombudsman pursuing case form to fill in
    9 October Received further £364.40 (includes interest) back :T

    Provider: Barclays Bank
    Amount Reclaimed: £1638.84
    Amount they paid:
    £1045

    Story:

    Took a month or two to get back statements to go through, but they did not charge for this (£10 cheque back) It took about 3 days on and off to go through and sort out.
    13th June - letter to Barclays
    20 July - reply back offering £1045

    I wrote and accepted this offer as heavily pregnant and suited me, this was just before the hold as banks went to court. The money was in the account within a week or two. Fantastic.
    Thanks very much all at Martins website, I have a 6 month baby now and the money could not have come at a better time. I have just done a small claim on Virgin too and will be debt free in a month. Enjoying the new tv programme by the way.
  • hi martin just to let you know i had 6 credit cards mbna barclay capitalone halifax etc got all my money back off them in charges moste without intrest so was very happy got about £3500.00 back in total so very happy

    EGG Credit Card - Won - £900 - 22days from data protection to money in account.

    Well, cant believe it but i Won, changed the letters a bit using the MOC template and another all in one, seemed to have worked, money in my account this morning!!!!

    No MCOL, no FOS, just letters.......

    The story: I sent off the 1st letter with the cheque for £10, got back every statement from the last 6 years. In letter 2 i asked for a full refund of all charges up until the date that they dropped to £12. I also mentioned that i would be considering adding up the interest incurred and adding that on also. I did not expect this amount back and was actually just hoping for the difference. 2 weeks later i got a letter saying they'd give me the difference plus 8% interest - £419 in total.
    I am very satisfied with this outcome.
