The story: Got the card at the end of September. I had set up a direct debit to pay the balance in full every month and had the letter to say direct debit was set up. Capital One did not collect first payment due, but my bank said that as far as it was concerned all was okay, so I paid by BACS, and cancelled the original direct debit in November. Capital One charged me for £12 for a late payment, and £27.38 interest.

When I spoke to them on the phone the next day (end of November), they tried to tell me that the charges were because I had cancelled the direct debit, but when I told them that the direct debit was cancelled on the 28/11 but the charges were applied in October, they put me on hold, and then agreed to repay both charges and set the direct debit up again.

I still have to pay Decembers balance manually though which is a pain.

I found that being polite but firm on the phone worked without having to write a letter but I still will follow this with a letter so that it is all on file.

    Provider: Barclaycard
    Amount Reclaimed: £128.86
    Amount Repaid: £125.28

Story: Sent SAR 3rd Nov 07

    Received statements 7th Nov 07

    Requested charges 8th Nov 07 of £116 + interest of £12.86 =£128.86

Recieved 'gesture of goodwill' offer of £32+interest At 8% 13th Nov

Sent letter back accepting the above as part payment on 22nd Nov but saying to resolve matter quickly without going through cout procedure would accept charge value of £116 without the added interest as final settlement.

Today 1st Dec 07 received letter saying have refunded to my account £32 charges +£2.56 interest calculated at 8% = £34.56 and as a 'gesture of goodwill' have credited my account with a further £84 representing the remaining charges + £6.72 = £125.28.

Near enough and without the hassle of going through MCOL.:money:

I'm well chuffed but bet they are not as obliging with the PPI claim.

    Thank you Martin.:T  :T :T :T

  • Bank: Alliance and Leicester MBNA credit card
    Amount Reclaimed: 46.95
    Amount they paid:37.57
The story: I had paid the bills in full at most two days late.I had always paid bills in full. So I had late charges of 3 lots of £12 levied against the account and interest, this is from 2007. I used the info on here to write the letters, I used the letter templates and modified it a little to suit my needs. I received one std letter in response to my first one and then followed martins guide with the second letter to threaten small claims action, again modified from my knowledge of small claims process and I added that solicitors charge at a rate of £180 per hour plus VAT. Then I received the second letter with the note to say my CC account will be credited for the above amount. They would not offer a refund for the interest that they charged. A std letter again. Its not worth claiming the difference of £9.
Easy peasy, but they should not have had the money in the first place.

(just a few sentences, please include how far you went did you a. just write a letter, b. threaten to go to court or c. actually go to court)
  • Provider: Capital One
    Amount Reclaimed: 2500

    Amount they paid: 2300
The story: Approached Capital one direct and was successfull in getting an offer from them, however this was about 50% of the claim.

Following the advice on this site and using the library of letters I referred my claim to the financial Ombudsman, 16 weeks later an offer was received that was indeed much closer to my calculation so I have responded to Capital One directly to accept.

Thanks for the letters and advice hopefully I should receive this payout before xmas :T
