  • Hi, has anyone had any success with claiming charges from capital one or catalogues simply be and studio?

    I have received ppi from capital one took one letter

    Cap1 are even refusing the ombudsmans initial assessment now.
    My case is now going to Ombudsman for final decision which of course will take 6 months or more.

    To anyone thinking of trying to reclaim £12 charges, don't bother unless you are prepared to take them to court. The ombudsman had decided in their favor.

    The story:

    I'm new to all this but stumbled across the excellent guide to credit card charges a few weeks ago and thought I would try.

    I had an old student credit card that I was struggling with and have been for years, I sent the template letter from MSE and added in a few paragraphs about how much I was struggling and how the card had a detrimental effect on my life. I asked for £459.66 with interest as that was the amount I could prove with the paperwork I had access too, I stated that I would settle for that amount but should I need to take the matter any further I would find out how much I was really entitled too.

    This morning, not even a week after I posted the letter - I received £1088.66 into my account. I am astounded.

    I hope this will encourage others, I didn't think it was possible.

    story -
    been meaning to do this for a while and so bit the bullet and sent of a letter from the template at the the start of november asking for the list of charges, no cheque was sent for this and they never asked for the fee!! they sent the list 2 weeks later so followed the templates again and asked for all the charges going back the 6 years ive had the card and asked for interest, just thought id try my luck! this was sent of beginning of december and got a cheque in the post last week for £810.36 the rest went on the balance of the card which was only due £10 and is now in credit by £40 so have now asked for card to be closed and refund sent. What makes me more surprised about the amount of fees and charges on this card is that the limit was only ever £350!!!!
    so a big HUGE thank you!!!! waiting on egg to find my account even though they moved it to barclaycard and its still live they have lost the charges and an old ppi on an old mortgage, will update if i hear anything about those.

    anyone not sure about this it was so easy for me with this one and am surprised these companies charge so much for basically 2 letters and a few minutes of your time! use the templates and go for it yourself!

    I am sending a reclaim tomorrow relating to 4 Capital One credit card charges of £12 when I was over my limit - since the average amount over limit for the 4 transactions was only £6 for 6.5 days.
    I believe the "amount" over limit and "length of time" over limit must be factors in determining the card company's costs of customer exceeding their authorised limit.
    In my case, these amounts and periods of time over limit are so small, I don't believe Capital One can justify costs of £12 charges each time.
    I'll update this thread and let you know what happens.
    Does anyone have any thoughts on this, please?

  • hi mse i have had a credit card with hsbc since early 1991 is there a possibility i may be due some repayment as a few times my payments were late and one overspend on holiday in turkey took near 5 years to pay off the debt!!

    The story:

    One letter sent to Sainsburys Bank in relation to a credit i closed in 2008. Used the template letter but also put in an explanation of my financial hardship, asking for the refund to offset against other debt. 2 weeks later a telephone explaining they deemed the charges to be fair, however to help with my other debts they will be sending a cheque in the post for the full amount of £260 (over limit and late payment fees)

    The story:

    Sent first letter dated 1st May 2012 for breakdown of charges with £10 fee, returned fee not required and sent details from May 2006.
    After a busy summer due to having to move and family issues eventually replied to first letter October 2012.
    Then had letter said could not log account as not had full number, which was strange when they had sent charges before without any bother!
    Due to not having account open any longer took some time finding old credit card statement, sent final letter on Feb 25th, had standard letter saying looking into case and will reply within 10th day on 4th March.
    9th March a letter stating charges are fair but have added a cheque for £236.87 including interest.
    They claim the fees are for the period of 6 years from first letter which I sent in May 2012. Therefore, they have missed several payments. Time to go back with added in financial hardship and should pay from my first letter in May 2012!

    Better than nothing but at least have another 5 charges to be paid and added to offer! Chancers... Very quick and not question.

    UPDATE!!!!!! - Very happy result :)

    First letter requested £358.71
    Natwest sent only some of fees no quibble but usual not done anything wrong but "here is a cheque". Made a call on Monday 11th March to number explained that had actually started the appliciation in May 2012 and they had requested more details which already had. Said they missed year 2006 fees and would like them. Once explained she confirmed could see send letter 1 May 2012 and understood why felt not been paid. Without saying anymore said would pay these and to cash cheque had and remainder would be with me in a few days.

    I did think may have to chase this up, but Natwest good to there word today Friday 15th March nice cheque arrived on doormat! Wait for it, for a further £261.45, I only asked in my initial letter for £358.71 but now have a total of £498.32! and extra £139.61. wow wow great in less than two weeks my final letter has resulted in £500 back, thank you this is great for one letter.

    That 1 down and several more in pipe line! What is very annoying Natwest CC pay out no questions, but dame Natwest bank does not look like will get much. Had shock today worked out that they owe with interest £5,100. Nearly cried knowing that have paid that amount for unfair fees! On a technical point in law they are getting away with not paying back our money which entitled too! See how it goes.

    Great result, do all apply to CC for charges paid no questions.. Cheers

    The story:
    I called HSBC mid Jan do enquire if I had PPI on any of the loans I took out after graduation from uni (from around 2002) There were 3 loans in total that rolled over.
    Following on from the phone call, I recieved a questionaire within a few days...i filled that in and recieved a letter dated 26 Feb offering me the amount above. I filled in the acceptance form and the full amount has been paid into my account today.
    I work in a company that offer 6 months full pay when sick and 6 months half pay, and would also recieve 4x salary in the event of death. This was my reason for not needing the insurance.
    At the time of taking the loan out, I was told that the insurance was needed as part of the loan.

    Just hope that this story spurs others on to make a claim, as the success stories here gave me the motivation to do it.!!

    Sent the first letter, received list of charges within a couple of weeks. Sent my claim (using martins calculator), received a cheque last week for £553. I'm more than happy to accept this as its more than I expected. Thanks Martin!

    Sent a letter from the template on 26/03/13 requesting £748.22, this is only for £12 overlimit fees (a couple of £12 late fees) + interest. I had simply used the template and added in that I had not been to work for the last 6 weeks as I've a knee injury and awaiting two surgeries (torn MCL/ACL :( ), and this is a substantial amount of money that I've been deprived of that I would otherwise have access to during this period.
    I've checked my balance this morning to see they've deposited £865.34 directly to my card (statement shows as 'OFT SETTLEMENT', deposited on 03/04/13). I actually had prepared a second letter last night, to note 29/30/31/01 April was a bank holiday weekend (6 working days since I placed the letter in the postbox!). I don't know where the additional money has come from either as I went over my statements thoroughly, maybe sympathy for my knee? I won't complain though!

    Additionally when I requested statements on the phone the representative questioned me as to why I needed them which I felt was a bit out of line, said I needed to check over payments. Charged £10, received the statements in the most pitiful excuse of an envelope which was torn and pretty much open. Photo's taken and will be claiming the £10 also :)
