  • I finally got a response from Natwest today.

    I never got a reply to my first letter, sent a second letter to which i gave them 14days to reply. Yesterday would have been 8wks since my first complaint so i contacted FOS as advised in the pack on here.

    This morning im pleased to say that i received a letter enclosing a cheque from Natwest.

    The original amount that i asked for was £705 in fees and interest. My second letter i said i would be willing to accept £524 but they have sent me £583 RESULT!.

    This included all the £12 charges that they had made to my account.

    I will be accepting this offer gladly so dont give up people, success is still out there :D

    Posted claim late Augest and I estimated I had paid about £1300 in PPI based solely on latest PPI amount * 84 (7 years worth). Letter acknowledged on 28th, got a letter on 7th September saying my claim had been upheld and that I had actually paid £1288.56 in premiums but as a result of them 'reconstructing' my statements in line with FSA refund guidelines they are sending me a cheque for £3252.37 within the next 28 days.:beer:
    5 more claims already submitted which using my crude estimate of PPI charges could be worth about £15k if they are all upheld. If they all apply the FSA refund guidelines I could be looking at something like doubling that based on MBNA refund and all for the cost of filing in a few forms, a few envelopes and some stamps. :j

  • It appears Cap1 are the only ones NOT playing ball now.
    I have sent off 2 claims, one for PPI and other for charges. They are stating there fair and legal and all that.

    I have sent them to the Ombudsman now, but I gather that the Ombudsman take forever and they don't alwys get the charges refunded.
    Seems like the best course of action, is to claim via the courts, but of course there's an upfront payment involved and you may have to go to court, so this puts people off.

    If the ombudsman decides against me I will sue them.

    Leaving the PPI issue to the other board, and concentrating on the subject matter of this oparticular thread, I think the MSE article is quite clear that any charges in excess of £12 are automatically considered unfair.

    Who says so? The OFT for one!

    The FOS complies with the OFT findings and will support any claim that charges in excess of £12 are unfair.

    (One exception that I am aware of is Egg, who have provided satisfactory evidence that their slightly higher charges, I think for £16, were actually fair all along)

    If you are alleging that the charges incurred by you are unfair despite not exceeding £12, then I don't think the FOS will consider this, at least not in your favour. Only a court can ultimately decide what is fair and what is not, so I suggest you waste no more time but go directly to court if this is the situation. :)

    Can I ask, how much have you actually claimed from Capital One relating to credit card charges?

  • Received an offer today from Barclaycard they have offered £1726 in total.
    I am gobsmacked...........I thought I had not complained well enough.
    I telephoned the PPI number several weeks ago,and had to go to my local branch,who gave me a copied form ,several pages in fact.Filled it out,sent it off,got a date from them ,for when they would make the decision by.No hassel at all folks. Reasons for this complaint being upheld,I quote "We are not satisfied that the PPI policy was suitable for your needs or that it was adequately explained to you when you took out the policy"
    :D It is a pity though that shredders were invented as my biggest spends were pre 2005. Mustn't be greedy:)
    Strange that EGG Quote the exact opposite to this in their answer to me just a few days ago.

  • I wrote to Lloyds TSB requesting £1225 refund in bank charges from 2007-2008. 24 hours later they put £970 in my account! And wrote to me denying any liability and the refund was a goodwill gesture!

    I want to say a BIG thank you to this website. I followed the advice and told the bank of my hardship at that time, and it worked!

    The story:

    i applied for statements in September 22nd this year. Didn't even send the £10. They acknowledged the complaint letter and then two weeks later sent me all of my statements from the last 6 years up until the account was terminated plus a final settlement letter

    The gist of the letter was that OFT said £12 charges were proportionate. I had two £8 charges but as a gesture of goodwill would refund them + interest. :beer:

    This has been credited to my card as I repay via a DMP. Not a massive win but still money I would never had got had I not sent a simple letter. I am very surprised by how easy it was. Still waiting to hear from MBNA and Barclaycard, will update again
  • Hi, at present fighting capitol one for ppi from 2002!! Curious to know how your getting on with your claim?
  • can credit cards companys use your ppi refund to pay the outstanding loan even if you never been in arrears and used the account within agreement conditions
