  • Why the hold up? What is there left to do?

    Issues further up the chain that can be resolved, but require time. I have to sell but I seriously don't know if I can carry on with the purchase. I'm so far in and I am starting to get very ill as a result of the stress due to stress linked illnesses. I've spent a lot of money and don't like any other house. My seller is refusing to move into rented. I personally feel like they're starting to take my patience so far forgranted.

    Coming up to 7 weeks this weekend.

    Not overly long in hindsight but there is no chain either side and the property is empty.

    Spoke to solicitor yesterday he said all but 1 of searches back due back this week, still has a query in with the estate agent although Hubs didn't ask what this query was :mad:
    He said that by the end of next week we should have a exchange date, I get the feeling he thinks there is a chain though despite us mentioning that there isn't. He seemed to imply we will have a date once we find out where he vendor is in the process.

    Will give it a week then call back, I feel we have had 2 weeks now of pretty much the same update. I want them to kick vendors solicitor and find out why queries are taking 2 weeks to answer!

    Surly if the house is empty the vendor is paying a mortgage on it, I would have thought they would want us in as soon as possible.

    23/8 valuation carried out
    24/8 mortgage offered
    25/8 instructed solicitor to start searches
    28/8 McDonald's confirmed vendors are ok with 19th exchange 26th completion
    29/8 letter with mortgage offer received from nationwide
    31/8 some searches back & fixtures form from seller received
    12/9 all searches back, waiting on answer to question about shared path
    18/9 signed paperwork, due to exchange 19/9 & complete 27/9
    19/9 EXCHANGED
    Get the keys on the 27th, no later than 1pm. Started packing this morning

    You only instructed searches on the 25th and you have exchanged, wow thats the quickest I have ever seen. How big was the chain?
  • My advice on waiting on 1 / 2 enquires for weeks -
    Find out what the enquiry is?!?!

    Ours was 'who is responsible for the small road near the driveway, us or the council?' for the to be purchased house.
    We advised our conveyancer it doesn't matter we still want the house regardless, we'll figure that out another day.

    She then wiped that one off the list and we were all done our end...

    I was told by an estate agent that some conveyancers make enquires to justify their fees, so it may just be a trivial question?
    But then again I don't trust either of them anymore haha

    In the event someone is buying a house with a mortgage it is usual for the solicitor to act for the mortgage lender, as well as the individual buyer.

    Therefore the solicitor has two clients to satisfy, and it may be that there are enquiries that the buyer themselves are not bothered about, yet the solicitor is still going to want a satisfactory response under their obligations to represent the interests of the lender.
