    Small wins, vendor answered the phone call appointment and their solicitor has confirmed they are “reviewing the file” (I’m hoping that won’t take another 2 weeks) and then they will report back to my solicitor 🤞🏻🤞🏻

    Hi guys thought I'd post here to start the wait! 

    So our sellers are wanting to move out on the 19th August... We're happy with that too, however their solicitors seem to think our solicitors won't be ready in time 🙃😅

    Thankfully we have no chain either end as we're coming from renting from friends and they're going into rented while they wait for their chain on their new house in the midlands.

    We have a gifted deposit from my parents, however if we complete on the 19th they will be on holiday abroad (from this Saturday they go til the 20th) so my mum is asking if they need to do anything before they leave... And I'm now a little worried because time is running out and our solicitors are slow! 

    Also, when it comes to paying for the solicitors fees, do they check where the money has come from?! It's not a problem if they do but I thought you could just pay it over the phone etc?!

    Ahhh I’m excited, my chain is now talking completion dates. The current leading proposal is 26th August (which being Friday before bank holiday is clearly a stupid idea but whatever). I’m renting so I don’t really care when - ideally we can exchange in August so I can give my notice for end of September.

    I had been getting a bit concerned that my mortgage offer which is now looking like deal of the century was getting a bit close to its expiry in October but we are now moving I think!

    From my side, we are waiting on responses to 2 petty enquiries and also to agree a completion date so my LISA funds can be requested but otherwise are all ready to go.
  • We can finally join this thread now.  Searches are all done, so just waiting on the vendors solicitors to answer the enquiries.  They insist only on postal contact so please pray for us  :| . We have emailed the estate agent today and said we would like to complete by 31st August considering this is a no chain purchase of the rental house we’re currently living in.  It’s all dependent on the incompetence of the vendors solicitors (who took 6 weeks to send the draft contracts), but we live in hope! 
    Enquiries back, and just received the contract and TR1 form to sign and return.  Name spelt wrong on the contract 🙈, but seems like exchange might be on the horizon! 
    Currently waiting for our solicitor to confirm whether they are waiting for anything else from the vendors solicitors, with the exception of their agreeing to a rent refund depending on our completion date.  We’re buying direct from the landlord, so can’t see how they could insist we pay a purchase price and rent on the same house but who knows.  Didn’t fancy letting the sale go through without getting it in writing that we’ll be refunded on a pro rata basis. Just want it to be ours now so we can rip up the rotten decking and get things fixed 😫

    It's getting more serious for our chain at the moment. 6 properties total, probate at the top - it was always going to be a bit of a tricky one. 

    Latest problem: Both our and our vendor's mortgage offers expire at the end of September, with no way to extend further. With how much mortgage rates have risen, we'd be looking at £400/month extra in interest for a new offer, which is... well, a lot. Similar figure for our vendor, who's now also said she'd have to reconsider moving if it came to that. 

    So the clock is ticking fairly loudly. Probate was initially expected to be granted end of July, now the EA's estimate is end of August. We're just pushing to make sure everyone has all their legal work sorted by the time probate is granted, and keeping all fingers and toes crossed in the meantime.

    Fingers crossed they’ll sort it for you! My friends have just had theirs expedited on their probate house they are buying. Think it was a fairly quick process. 

    Yeah our vendor is buying a new build and had one enquiry that no one seemed fussed about resolving but her solicitor wouldn’t exchange without it. Thankfully we’ve all agreed exchange and completion for the week of the 22nd august. We’ve applied for a 4 week mortgage extension just in case (though no guarantee the lender will say yes), but we have no plans to tell our vendor this as no doubt they’ll just use it to drag the whole thing out even more. Quick sale we were told 😂

    Actually, I've just realised that the website that I came across was w.r.t. land registry updates, rather than probate applications:

    Looks like for probate applications, the criteria for expediting might be more strict: https://www.hughjames.com/blog/probate-registry-delays-–-an-update
    "Whilst the probate registries are able to expedite grant applications in cases where property sales were agreed before the deceased died, they do not consider applications where the sale was agreed after the date of death to be urgent. There is, therefore, a real risk that property sales will fall through in cases where buyers are tired of waiting for the grant to be received, in order that contracts may be exchanged. "

    So I don't think we'd be eligible in this case.
