solicitor called and she explained everything. Halifax has refused to lend until the problem is sorted regarding the 1st ranking security and will not accept the indemnity insurance.Basically all the sellers solicitor needs to do is write a letter of undertaking to say they will discharge the old standard security with a draft discharge letter.Our solicitor has offered to give him 3 yrs to do this and once he writes both those letters we can move forward with the sale…. Simple
but sellers solicitor is refusing to do this and my solicitor does not understand why he is refusing she said this is part of the conveying he is paid.We called the seller and explained all this so now he is going back to his solicitor so hopefully they will get a move on0 -

Hopefully the magic key 🔑 dust comes your way this week!She thinks maybe it’s down to not wanting the extra work but as she said it’s not as if it’s an old bank that doesn’t exist it’s TSB he just needs to write a few letters and wait on the bank tracking down the old security account.The old security was for £10k in 1983 and if there was any outstanding money due she said the TSB would be looking to take the property back etc so she fully believes everything is paid so doesn’t understand why he is refusing, she said if he had of done this in the first place we would be in our property just now0

Feel for you @rose_T It really does sound unnecessarily complicated, but good that you have a solicitor willing to fight your corner. Hope it gets sorted before too long.0

@rose_T - hopefully the vendor can get their solicitor to do what he needs to as it seems madness to just do nothing! Hopefully common sense will prevail x0

Sent off initial enquiries on Friday.. hoping to hear back this week. Last local search due on 11th and survey on 12th.FTB
23/6 - Offer accepted
7/7 - Application for mortage
8/7 - Searches ordered21/7 - Mortage Offer issued30/7 - Contract pack received. Enquiries raised.
9/8 - Mortgage Deed signed and witnessed.
11/8 - Searches returned.12/8 - Survey completed. Nothing major.
23/8 - Home buyers report received.
6/9 - Enquiries response received.
15/9 - LISA deposit paid to solicitors
5/10 - Contract signed27/10- Seller pulled out at exchange15/11- Exchanged0 -
We’ve got the enquiries, the contract for our sale has been sent to us for signing and we now just have to send off responses and our marriage certificate as that happened post original purchase, they’ve asked again for dates x0
