    Good afternoon,
I was about to exchange contracts on a property (title number WT272623) when the vendors solicitor noticed there was a charge against the property the charge is a notice of home rights under the family law act 1996.

If possible, please can you tell me if this has been requested to be removed? and how long it will take?

    Thank you
Nothing as yet. When they apply ensure that a request to expedite is submitted separately to ensure as short a wait time as possible

    Please could you help me;

The house we are buying has freehold title and an unregistered leasehold title. The leasehold we are told is in the name of the people selling the house (they purchased both from the developer many years ago). Clearly we cannot move forward until this issue is resolved but how quickly will the land registry register the leasehold when the application is submitted if the sellers solicitors expedite the request?

    Thank you
If they get it expedited then it’s generally considered with 2 weeks. Everything then hinges on it being in order.

    Hi @Land_Registry

I am purchasing a flat at the moment and I believe the vendor solicitor has applied to I) remove 2010 charge and ii) demise a parking space to the title plan. The title is TGL334313.

Would you be able to provide and update on how long this will complete? I really need to complete in a a month so I wonder if this was expedited/needs to be expedited?

    Regards
Lodged end of August as a correction so it’s been processed and we are now asking form more from the conveyancer.
Looks like point 1 is the hold up as we need more from outgoing lender. I’d suggest contacting seller’s conveyancer to clarify timescales for a reply
Hi @Land_Registry, I have been told that the previous solicitor has provided outstanding info re: 2010 charge and also requested expedition. Would you able to check the latest status? Also, does it mean the 2nd point (parking/title plan) has been resolved, and it is just the 2010 charge that is outstanding in order to get updated OCE for title TGL334313?

The application is still with us as we’ve not yet received a response to our request for more
Whilst an expedite request was made we can’t do anything with that as processing/checks had already begun so no actual wait time to reduce. The wait time is now the conveyancer’s
It looks like it’s just the outgoing charge that’s the hold up from here

Many thanks, I will chase the conveyancer.
  • @Land_Registry I was wondering if you could help. The house I am buying has a pending action. I believe it was applied for in May, could you let me know current timescale for completion?

Many thanks - there’s a pending application to register a Unilateral Notice, which can cover a pending land action. As lodged in May it’s a way off being processed as yet.
As a buyer you’ll want it out of the way so suggest your seller’s conveyancer requests expedition
