    Hi,

    Looking for some help. My land registry ref number is EA88FD3.

    I offered on a shared ownership property back in February, the searches came back in May and flagged up issues with land registry titles.

    The application was successfully expedited in Feb. I was told that there were 3 outstanding requisitions to be resolved by the lodging solicitors before it could proceed. I’ve gone back and fourth for months trying to get the solicitors to resolve these 3 points. 

    This has finally been done however I’m now being told that the titles still can’t be done because of 12 - 18 months backlogs!? i thought that because it was expedited it could be done ahead, but apparently not? 

    I want to know exactly what the issue is and why the titles can’t be done?

    Additionally, I have asked my solicitor to compete without the full titles (based on the uncertain time frame) however I’m being told this is not an option?

    I have some queries about the charges register & the restriction in the propertiership register. If you’re able to help, Info is below :)

    b4 on title: restriction - what does this mean?

    c2 the transfer of land between bellway homes and previous owners. Is there a reason why their names are still on this title? I purchased this house as freehold (there was a leasehold title but this was merged)

    Hi, hope you can help. 

    I was hoping to exchange on a property yesterday until our solicitor found an additional charge (another mortgage) on the property w're looking to purchase; said solicitor was already aware of one mortgage, but not the other. This additional mortgage dates to the mid-1970s and the bank/company/lender no longer exists. The seller is not aware of the existence of the mortgage (ugly divorce), so would you kindly be able to advise how the seller and their solicitor go about removing this additional charge from the property please? Many thanks. 
    It all depends how it’s registered and to whom. If it’s a mortgage I assume it’s a registered legal charge so if it’s a dissolved company they need to consider how that works legally re the charge

    Not yet and I wouldn’t expect it to be until later in August/early September based on average timescales at present

    The restriction is a standard lender’s restriction so you can’t for example transfer the title without their consent.
    The Transfer contains restrictive covenants entered into by the developer and first private owner. The covenants bind the property hence it being referred to on the register. To identify it the date and parties are referred to

    So the mention of their name is more of a historic record? 
    As the lease for the house no longer exists on the freehold does that mean the covenants also do not apply? I’ve got a copy of the original transfer details and what the first owners were and weren’t allowed to do. 

    Off subject, how do I find out if I’m allowed to put up a fence (below 1m so local authority do not need to be asked) is the land marked in red on this title ours?

    Hey, just double checked and EA88FD3 is the correct ref number and is found under this when I call up. 

    Also have the title numbers -
     DY561107 (New Title)

    DY531957 (Parent Title)

    Or customer reference 

    GTAL01/039775.00445(P44)

    If you manage to find it, I’d also like to know when the 12 - 18 months time frame starts. For example is it from the date I offered on the property?

    Not a historic record but to help anyone understand which Transfer contains the covenants referred to. Those covenants still affect. 
    if the lease has been determined by merger then the terms within the lease itself have come to an end. 
    Regarding your fence have a read of the transfer 
    The registered extent will be outlined in red on the title plan. The transfer will also define the transferred extent.
