  • Good Morning,

    I was hoping you could help or provide advice as we are having issues with Land Registry with regards to our house remortgage. 

    We purchased our freehold and this was submitted by our solicitor to HMLR mid September of last year I believe. 

    We are trying to remortgage but the lender has said that the register needs to be updated before they can agree to the mortgage. 

    We then asked our solicitor to raise an expedition using our mortgage offer (31/3/22) as evidence but we are already moved on to variable rate now as it is. 

    The response to the expedition was that this could not be processed any quicker due to developer of our estate having lots of records to update and that had to be in a certain order. 

    Our land registry title is: YY77176

    and the registry title for the estate is YY49275

    Were quite stuck now and really dont want to be stuck on a variable rate for an extended period of time. Is there any advice you can give on what else we can do or how long it could take, our solicitor didnt know the potential duration when asked.

    As you state it’s a very busy development with a wide variety of prior applications pending all of which should normally be processed ahead of your own. 
    It’s not been expedited, which is odd if requested as it could be but not processed as quickly as you/we might like 
    There’s nothing you/your conveyancer can do directly at this stage but if it’s not in order the ball lands back in their court. 
    I’ll see if I can get a better steer from casework colleagues as to whether there a path they can pick to try and get it processed sooner than current timescales suggest

    Expedition, if approved, reduces the initial wait time. What it doesn’t do is waive all the registration requirements, including any applications already lodged and affecting/having priority over your one. 
    Priority isn’t all about when submitted but more about what impact it may have on the seller’s title and therefore your own purchase. Invariably none but if you’ve got 50+ prior applications to consider then there will be delays and a single expedition will find it extremely hard to progress quickly compared to if it was the only one to consider

    I have pressed for more information from our solicitor which may help you with your caseworker colleagues.

    It seems the latest correspondence was that there was an error with the application originally 'wrong application type was selected when submitting through the portal. "Document Registration" was selected instead of "transfer of part" ' but instead of cancelling the registration it has been amended by HMRL 'in order not to lose it's priority'.

    We have been provided a new case number 'YY163078' if this will help to get more information from the caseworker. I'm now wondering if a response (or rejection) to this original request to expedite has actually been made and that we need to raise a new expedition request, (i have requested our solicitor/conveyancer to do this), against the new title.

    But like you say even so, even if an expedition request is accepted, this may mean that it might still not be processed in the 10 days but just move us up the priority list for the sellers title.

    I filled out one of these forms approximately 5 months ago and again 1 month ago. The 3 houses in question have still not been listed on the land registry sold prices page....

    Those forms also ask specifically for the price the property sold for and the date, which is information I do not have. Do you enter data based on what members of the public send you in these forms? seems a potentially inaccurate way of doing things as anyone can fill out these forms...

    Where would the Land Registry typically get the sold house price information from? a solicitor? Can't someone at the Land Registry find out the sale price information themselves for these properties if I just gave them the 3 addresses?

    No, we enter the price paid data based on what’s submitted so the legal deed (transfer) and application form 
    There can be reasons why some purchases don’t appear whilst others do and of course you can’t be sure that the other purchases were the same as any other sale/purchase. 
    Suggest you try the contact form and ask why yours appears and they’re ones don’t

    No, we enter the price paid data based on what’s submitted so the legal deed (transfer) and application form 
    There can be reasons why some purchases don’t appear whilst others do and of course you can’t be sure that the other purchases were the same as any other sale/purchase. 
    Suggest you try the contact form and ask why yours appears and they’re ones don’t 

    There should be no reason why the others do not appear.

    Weirdly one appeared about a year ago, was there for 2 weeks, then disappeared never to return.

    Land Registry do not do anything with these contact forms....I have done 2 now!

    2 years on and only mine is listed. It feels like I am the only one naked at the nudist beach.

    Hi just a quick question .

    I am current completing a FR 1 form for my a property my OH has inherited. I am also completing an AS1 form. Do I pay 2 sets of fees? 

    I am the executor and Probate has been passed etc.

    We have an estimated response date of the 26th January for an AP1 request filed in September. This was done via the portal with mt Solicitor.

    Is this likely to be delayed at all? Generally - are these dates met?

    Will we get an informed response to the request regarding any information in relation to why this part of land has been unregistered from yourselves?
