is this a body I can use to raise a request of FOI with DVLA?

Yes, you paste your questions into the box and it gets sent to the DVLA FOI email address automatically. The questions and replies are published on the website and you are notified by email that they have answered.

Its a very easy system to use.

Whilst it doesn't hurt to try, do the DVLA get copies of the NTKs when keeper details are requested? If not then points 4, 5 and 6 won't be in the DVLA's purview.

The email explained it as they do not see what the companies do with the info afterwards or get copies. (otherwise they'd see all the dodgy/incorrect wording I'd think)

They don't get copies of NtKs, but it makes them address the fact that they have no idea about what is going on - and in view of the current evidence following the 2016 evidence, provides for a follow up about why they've allowed this to continue, possibly through their negligence in protecting the public by continuing to provide personal data to G24 in Scotland without further checks.

Maybe they'll pressure the IPC too as to why they didn't monitor this. Did the DVLA require the IPC to monitor the situation post 2016?

A mere starter for ten - potentially.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I wasn't saying not to do it, just preempting DVLA's response. :)

    You could maybe add

...please explain and provide copies of the controls put in place to ensure G24 did not repeat their misleading claims post x.x.2016, and how this was monitored and reported. Please also state when any period of monitoring ended. If no such controls were put in place to prevent a repeat of the breach in the DVLAs duty of care over personal data, copies of the ladivce, including legal advice, given to the DVLA as to why such monitoring was not necessary

May be way off base, but it hopefully short cuts as it shows they should have systems in place to sjhow compliance....

should I include this in contact to the DVLA or FOI request?

  • I parked in the car park at B&M's in Falkirk. I work in the community and had to meet a patient in a pharmacy so as it was nearer to the pharmacy, I parked there. My meeting took longer than the time given and was over my time by 26 mins. I didn't see any sign. Due to confidentiallity reasons I'm unable to provide prove of this. I received a parking charge for £90 and have ignored the letters sent to me. I'm a bit worried about any legal aspects that could come my way. I don't live in the area so would not have known. Not sure but have read the threads and watched a programme on TV last week about this. A lady who worked in the hospital had a problem with her car park pass and ended up with a huge bill. Are you sure I should ignore it?

Shuzza, please don't hijack someone else's thread. The advice here is purely for the original poster.

You should delete the text in your post above as it gives away the driver's identity. Never ever do that in Scotland.

The NEWBES is up to date and relevant. If you need further help you should start your own thread.

  • Hi there - I got an invoice from G24 on 17/08/2017 for the very same B&M car park (£90). I'm the registered keeper. I received a 2nd letter from G24 in October and just the other week got one from Debt Recovery Plus Ltd (DRP) from one Jennifer Jordon (£150 now) with the much quoted line: 'In certain circumstances, liability can be transferred to the registered keeper.'

So I think it's fair to say that G24 and whomever they get to act on their behalf are not being held to account by DVLA for sending letters out that aren't accurate.

So just to be a complete pedant, I want to check my understanding of what's been said so far... with the law being different in Scotland, the most G24 can legally do, is invite the registered keeper to share with them who the driver was and the registered keeper is not legally obliged, under Scottish Law, to provide any details of who was driving the car and that the registered keeper should not reply in any way to the letters they receive from G24 or their sub-contracted companies.

I'm up for getting on to DVLA if the experts on this forum think I should. Not looking to hijack this thread, so if you want me to start a new thread, please say :) It seems to me that we could be pooling our resources on this issue for the specific car park in Scotland and save the knowledgeable people who provide advice from having to repeat themselves so much??

The letters received so far: hxxps://xxx.dropbox.com/s/e7sw007ad4qvnnh/G24_DRP_ltrs_Redacted.pdf?dl=0 Please can someone tweak the link for me?
