g24 ticket from b&m Falkirk,Scotland... Help!

  • G24 have been caught doing this before in Scotland. Gladstones said it was a "mistake". See if you can print the email to a PDF file and send a complaint to david.dunford@dvla.gsi.gov.uk and ask him to investigate the matter as G24 have done this before.

    I'm going to do this now with the original email as I have received another debt letter from g24 stating the fee has went up.
    The manager in b&m basically said she would not be able to find my receipts, that it takes too much time and when I insisted told me she's call me back (without asking for my details) and the never bothered- all she has to do is pull my receipts or cancel the tickets. its a joke

    It's possible she's clueless enough or just doesn't want the hassle. Take it to their head office, with any proof you have of being a customer on other dates and tell them you will no spend another penny with them until the PCN is cancelled. Send in a few Home Bargains receipts from after the PCN date to show you've changed store (they are owned by different groups, right?).

    Then focus on the POFA thing - you should be complaining to the DVLA, BPA and Trading Standards because they are deliberately lying to you.

    I would perhaps suggest trying to garner local support. And also pointing out to the store that by employing a parking company to manage their land, and by allowing that company to claim inflated & extortionate amounts when their losses would have been nil otherwise, that they have also lost themselves £x per week/month from you in revenue.

    Tbh, as long as we keep using stores who engage these companies and allow their practices, nothing will change.

    Hear, hear. While PPCs get most of the broadsideon here, it mustn't be forgotten who actually engages them to harass and intimidate their customers.

  • We rely on the statutory authority contained within the Protection of Freedoms Act to enable us to seek payment from the registered keeper (if the driver does not pay within 28 days) and this overrides Section 4(1) of the Unfair Contract Terms Act 1977. The Unfair Terms in Consumer Contracts Regulations 1999 are also not relevant to the point raised because the Protection of Freedoms Act has come into force since then.

    ^^^ the above is the mention of POFA in the email I received from them. so no excuse of a typo/missprint. I am emailing it to the addresses suggested in this thread to be investigated

    I also have now received a letter from a debt collection agency DRP Ltd, working on g24's behalf- fee now @ £150

    Just email the dvla with copies of everything.
    Ask for g24 access to the keeper database to be suspended.

    Raise a court claim against G24 for breach of the Data Protection Act? (Letter before action first). After all, as there's no legal mechanism to transfer liability to the keeper in Scotland (yet G24 have tried to use that method) then their request of your keeper details from DVLA was without just cause. :)

    I've had an email back from David Dunford with the DVLA and he has confirmed they should not be quoting pofa. He has asked if he can contact g24 using the email evidence I sent him to find out why they are quoting pofa.
    My worry is this will make g24 even more adamant that they will not drop my 'invoice' as I have now caused them issue... ?
    I am still awaiting a reply from B&M head office,compaints,ceo in regards to the poor service from the manager and the issue with g24.

    As for g24 accessing the keeper database, the answer imply's that g24 can do this to make contact with the driver/keeper, I assume as the driver may be registered in the UK? I would however think g24 should not be allowed to request for details of a car when the space they are managing is in Scotland- where pofa does not apply. Though they will no doubt argue it is still valid to gain access for correspondence address.

    My hope is now that B&M go above their head and remove the invoice- as they have been informed of the companies false information being used and the complaint I have made against them.

    I just want this matter to be over and closed. I suffer with mental heath issues and am unable to work at the moment from this. The extra stress and anxiety this matter is giving me is not needed. not to mention the threatened cost.

    I am looking to do this but I am waiting to hear if they can still access the keepers database as the incident happened in Scotland- on the basis of contacting who may own the car. even though POFA is not valid, they could argue they still had the right to contact me. It was my reply, where I let slip I was driving- is now the reason I am indeed liable to their invoice.
