The small bags used to be free. The LAW is that they HAVE to charge for small one use bags. Is that clear enough now?!

They used to be free when Marks and Spencer 'chose' to charge for their larger bags. No law.

They ARE being honest and they're treating you like a fool... because... well I'll let you work that out. They don't have to supply paper bags because you want one for your special cake.

Do show me the law on that, the legislation I have seen is paper bags or bags without handles do not need to be charged for.

This is the information for retailers

    Bags you charge for

You must charge at least 5p a bag (including VAT) for carrier bags that are all of the following:
    • unused - it’s new and hasn’t already been used for sold goods to be taken away or delivered
    • plastic and 70 microns thick or less
    • it has handles, an opening and isn’t sealed
This is the link https://www.gov.uk/guidance/carrier-bag-charges-retailers-responsibilities and was updated on 17th March 2017. Are you saying the legislation has changed since then?

That statement reeks of self importance.

I'll tell you now why places don't use paper bags it's because of the freeby/compo seekers. Basically if a bag split in the old days whilst walking out of the store many people would expect any broken items to be replaced for free. Paper bags are much more prone to breaking and if Supermarkets gave them out people would try and stuff them with as much as possible to avoid paying 5p, loads will break because of stupidity. It's easier for the retailer just not to have them rather than deal with all the nonsense that would occur with constantly breaking paper bags.

I was buying underwear, it really wouldn't have broken if the bag had broken. Bags without handles are much less likely to suffer from this anyway.

You didn't actually say what bag they tried to charge you for.

If it was for their standard plastic bags then it IS the law to charge.

Just because you wanted them to have different bags doesn't change the law regarding the bags they do have. Doesn't seem like there was anything 'thick' about the employee, just the customer.

You enjoy your 5p boycott, and MNS will continue to enjoy the massive mark up on that cake that makes your boycott pointless...

I didn't ask for a free bag in the food section, it was in the clothing section. M&S doesn't just have a foodhall.

Well customers are important, lots of retailers forget that and it might explain why some are successful and others have falling profits.

I don't accept being lied to. They could stock other bags, they used to it wasn't all carrier bags. They have decided to lie to people by saying they have to charge for all bags and in so doing they don't need to supply the small bags they used to supply. That is their choice, but they should be honest and not treat people like fools. You may be happy to be treated as a fool but some people are not.

Their profits are down so maybe they need to think about their relationship with the people who pay their wages?

You have already been told. There is no profit in the bag charge.
Im sure M&S's core customers are likely to have a decent level of environmental awareness and either not fussed over 5p or bring their own bags.

Does that not depend on how crispy the underwear is?

I think you missed my point, I don't object to paying 5p for a carrier bag, I object to being lied to and told a small bag without handles also has to be charged for when that isn't true.

The legislation states when bags have to be paid for, M&S lied to me and said all bags have to be paid for. You don't have to pay for paper bags, you don't have to pay for bags without handles, you don't have to pay for bags that have been used (which was relevant to me as I was picking up an item from customer services and they had a box of old carriers that had been returned with goods and they insisted they had to charge for them as well.) There is nothing to stop M&S charging for bags but they shouldn't lie to customers. How can you trust a business that deliberately and repeatedly lies to you?
