    I have just read the thread on the link you sent me .... should I mention in my letter saying what you have told me to write above that the sign has BPA on it and they are not me members?


    I do have a photo I took yesterday showing it with the BPA logo on

    "I challenge this 'PCN' as keeper of the car, as the Resident has primacy of contract and there is nothing about £100 parking charges in their Tenancy Agreement so as keeper of a car that was a legitimate visitor of a resident with existing rights, I rely on the Jopson v Homeguard appeal case in support of the position.

    Should you obtain the registered keeper's data from the DVLA without reasonable cause (e.g. if you do not fully comply with the BPA Code of Practice in terms of signage at this site, for example) please take this as formal notice that I reserve the right to sue your company and the landowner/principal in your contract, for a sum not less than £250 for any Data Protection Act breach."

    For the avoidance of doubt, I do not give you consent to process data from the DVLA relating to this vehicle, whether you have already obtained it or not.

    I have kept proof of submission of this appeal and look forward to your reply.

    Why are you mentioning BPA when this parking company are IPC members?

    Why are you mentioning "Should you obtain the registered keeper's data from the DVLA without reasonable cause"? They either already have done so (if you received a postal notice), or they won't need to (if it was a windscreen ticket) as you are already responding to it.

    I still don't think you've got your head around this yet.

    It depends on which BPA logo they have. They can be BPA corporate members but not BPA AOS (Approved Operator Scheme) members.

    If they are IPC AOS members (they are) then you need to reference the IPC Code of Practice.

    If it is private land within a housing estate it is residential land. That is why the wording of thee lease is vital.

    Is it the BPA roundel that only AOS members use? Or just a BPA membership triangle (which they are allowed to use if they are merely members of the BPA). If the latter, it isn't a problem and they are not claiming to be AOS members of the BPA.

    Its the round symbol above the BPA logo ... I have zoomed in on the photo I have taken and its to blurry so I cant see if the letters say IPC or BPA ... I will ask my friend to go outside and take a look

    UK-CPM are IPC members.
