Hi everyone
So I have had a response from CPM
they arent accepting my letter as an appeal as you predicted
They have said they need the following for me to make an appeal :
Full name of driver and address
PCN number
Vehicle Reg
grounds of appeal
they have also said they wont send me a copy or any details I asked for as they don't have to, and that the contract between them and the landowner they are working for as it would be a breach of data protection act ....because they have entered a contract with them... so my question is surely if that is the case then them sending my details to a third party would be a breach of the so called "contract" between me and them I have entered by parking there ???
I have photos of the sign as well insert them on here !! it wont let me0 -

They are lying. You must NOT tell them who was driving under any circumstances, and there is no law in the land that can make you do so.
Yes of course they need the PCN number, VRN, and name and address of the person who is appealing, but they must not ask for the driver's details.
They won't answer any of your questions because they are scammers, and if they gave you the answers they would shoot themselves in the foot. That's why the template is writ that way to so you can show they have behaved unreasonably.
So, if you didn't tell them who was appealing, you need to send the IPC template again and include name, address, and VRN of the day to day keeper (who may or may not be the registered keeper), but NOT the details of the driver.
Once you have done that you go into ignore mode. If you did give them that information then you are already in ignore mode.
You still need to find out what your friend's AST/lease says with regards to parking and let us know.I married my cousin. I had to...I don't have a sister.

I challenge this 'PCN' as keeper of the car.
I believe that your signs fail the test of 'large lettering' and prominence, as established in Parking Eye Ltd v Beavis. Your unremarkable and obscure signs were not seen by the driver, are in very small print and the terms are not readable to drivers.
Further, I understand you do not own the car park and you have given me no information about your policy with the landowner or on site businesses, to cancel such a charge. So please supply that policy as required under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.
Should you obtain the registered keeper's data from the DVLA without reasonable cause (e.g. if you do not fully comply with the BPA Code of Practice in terms of signage at this site, for example) please take this as formal notice that I reserve the right to sue your company and the landowner/principal in your contract, for a sum not less than £250 for any Data Protection Act breach.
For the avoidance of doubt, I do not give you consent to process data from the DVLA relating to this vehicle, whether you have already obtained it or not.
I have kept proof of submission of this appeal and look forward to your reply.

Or would you suggest I just write back saying they have no right to the drivers details and I expect to see the contracted details between the land owner and themselves ...or Ignore completely now...

You need to go through all your posts and edit them to remove all the admissions of who was driving!!

I do not think that you have got a grasp on this, you have completely ignored CM's post number 33.
You have not mentioned anything about this being residential parking and your friend may have leasehold rights to visitors' parking. Have you yet seen your friend's lease/AST? You will get nowhere trying to persuade the PPC that you were parked harmlessly, all they want is your money.You never know how far you can go until you go too far.0 -

That's the wrong template. You want the one for IPC members. I thought you knew they were in the IPC.

OP you look to have half heartedly edited.a couple of your posts after reading #45.
You do need to go through all your posts and edit where necessary.
#3 in the newbies FAQ thread advises against any further appeal to IAS.
Better to devote efforts to getting the landlord/agent etc onside to get it cancelled, as well as the residents paperwork.
You are now in the wait and see,/debt collectors stage.0 -
