    I am already on antidepressants for anxiety and panic disorder! I told the manager that this has made my anxiety worse and she was acting all sympathetic but still saying she has no weight in this. She did say she would write a letter explai I g my mental Heath issues as well as dyslexia and how I did not know of the time limits etc. I got very angry with her when she said that it's my car and I should be aware of parking times! If They sorted out the NHS then people wouldn't have to wait so long in the waiting room and over stay!:mad:

    now invoice the surgery for taking so long to treat you! , who the hell set that time limit has not seen a full waiting room !


    If they kept you waiting for longer than the draconian time , set by PE , THEY should get it cancelled

    at this point I would simply tell the manager that if PE issue court papers , you will then instigate a counter claim , and YES they will be a party in the claim


    simple as <full stop> all claims by PE cancelling , an apology (in writing) from them and your vehicle on a whitelist

    You have plenty of ammunition, as above dont get mad, get even.
    As for them refusing to hand over the contract, you should ask them for a full and redacted copy and if they wont supply one state that you will be claiming under the Freedom of Information Act and that as an NHS facility they will not be able to claim commercial confidentiality as justification for refusing it/redacting any part of it.

    Sophia has lied to you, if this has caused you stress ( which it obviously has) you can counter claim, or put a separate claim in for harassment , naming the surgery as principal, this in effect could mean that Sophia , or the surgery/practice manager/whoever is in charge will have to attend court, and give reasons as to why they have ignored the NHS guidance.

    Even if they do see sense then at the very least you should FOI them for the full and redacted contract

    If you are feeling upto it then go ahead and counter claim, if you are not sure then you should make them aware that you may counter-claim/issue a claim, or are seriously considering it

    Also from what I understand the NHS sees attendance at a clinic, or who attended and when as part of patient confidentiality, if so, then by allowing a private company to write to the registered keeper of a vehicle ( who may not be the driver who attended that clinic on that date) breaches this as its likely that the Registered keeper would have known who was driving on that date.

    And one more thing for now, do not phone, you must stop all phone calls and only communicate via email or post ( making sure you keep a copy of any thing sent by paper) if you do ohone, or receive any calls record them but make sure you inform the other party that this call is being recorded an may be used as evidence before even saying anything else

    I would say that if I knew what the hell I was talking about! If it goes to court I will find out how to counterclaim

    I did refer to the link someone put up earlier about nhs car parking and she said it's not an NHS car park and that information is in regaurds to hospitals etc

    How do I get them to give me a copy of the contract? I have asked her twice already. You have a point about the confidentiality of patients l!! How would I go about a counter claim? I know nothing about this sort of thing

    The car park belongs to the clinic, or the Clinic have engaged with Parking eye to be present in the car park, correct?

    You need to tell them that you require a full unredacted copy of the contract, and you will be making a formal claim for it under the Freedom of information act if they will not provide it, you must also tell them that they are Not able to claim commercial justification for withholding it

    just remember ,based on the (in) correct %%%l %%%t she has spouted so far , inc many lies not to take anything this pen pusher says as the truth

    write down all you can remember about your phone calls and talks to ALL staff and PE the incident(s) happened in 2015 , so PE have still 4 yrs to start a claim , stop worrying , but from now you will require home visits .

    I still think there is a specific reason PE have not started court action , it will all come out eventally

    the contract that will never appear ? , was it the sergery , was it the counsil , did it exist at all?
