Oh I did do t you worry about that!!! I'm not some little sheep they will get away with playing with. This is why I have not paid the ticket and why I joined this forum for advice if it goes to court!
I ain't got a clue about all the legal stuff so I want to get as much info as possible. Her attitude is really disgusting and she can sit there smug untill she gets called into a meeting from her boss! I'm going to put in a formal complaint0 -
The female manager just called me back and said there was a misunderstanding from her manager and that it is her job to deal with PE. She said that she's waiting to hear back from PE and will let me know ASAP. When I informed her that they would have to come to court with me if this is not sorted out she simply said they have had a few patients from the surgery taken to court from PE and they have never had to attend. I can't believe that this is a regular thing with their own patients yet they continue to use PE.
Seems to me this is a pretty stupid manager ???
If they don't go to court, Parking Eye will and it becomes a default judgement

Having read through all the emails between the manager and PE I came accross this one:
'This case can’t be cancelled due to the stage this is at however we could look at possibly reducing this.
We received an appeal back in June 2015 which we asked for consent to contact yourselves to confirm the visit. We didn’t receive a response. We then sent a letter in August 2015 asking again for consent – no response was received.
We then passed the case over to DRPL in June this year, we still received no response so as a result the case was passed onto a 2nd Debt Recovery company. The case amount is now £160.
The motorist has called today (which is the only time from what I can see) to say they wouldn’t be paying this and ParkingEye can take them to court.'
Does this mean that it's going to court then? I sent Back the form they are on about and then heard nothing for ages. PE need to hurry up and get back to the manager as this is stressing me out now.0 -

So you can tell the clinic they are liable and need to get it cancelled even if it costs them money because they mucked it up, not you. If they do not take this seriously and you end up out of pocket you can tell them you will sue the clinic for the £200-odd that you would end up paying in court, plus damages for distress.PRIVATE 'PCN'? The email is between the clinic and PE. PE are saying I did not give Vincent to contact the surgery to confirm I had an appointment. I did they just didn't receive it0 -
I just heard back from the manager and I'm so annoyed and confused!!!!! Apparently the outstanding ticket is for an occasion where I over stayed the 90minutes!!!!! !!!!!!! The only time I had two appointments was on the first ticket that my mental health worker(who I had a second appoint with after the docter in a private room at the surgery) she wrote to PE explaining this situation and it was cancelled. When I started receiving letters I assumed it was the same fine till k was informed it was a different one, so I assumed that I must have don't what I always do and entered my reg wrong. Turns out I put it in right but overstayed my time while in the doctors! !!!!!! is going on?? I'm so stressed out now and being told that BOTH Tickets are outstanding? Grrrrrr. This is causing me really bad anxiety now. Here is the email she just sent me! I'm confused as to !!!!!! is going on!
'I have passed your concerns into my manager to see if he can do anything further for your case. Due to the time frame laps, I believe it is unlikely that we can do anything further but I will ask my manager to confirm this.
I have spoken to Parking Eye (PE) and they have stated that due to the time laps, they cannot cancel the fines as they have been passed onto an independant debt recovery firm. I do understand your frustration and I have spent some time trying to make an easier system for our patients to use this service and to contest fines appropriately. If you had contacted PE in the allocated time frame and sent them a completed consent form, we would have been able to cancel these fines back in 2015 but due to this process not having been followed unfortunately it has resulted in these fines continuing.
PE have informed me that you have two outstanding fines, one from 29.5.15 and another from 17.9.15. They say that the first fine was contested in the correct timeframe by someone on your behalf but that when they sent you a consent form to sign for them to confirm the information with us, this was never returned and so the fine was upheld. The second fine has never been contested and was from a time where you had typed your registration correctly but had overstayed the allocated time frame of 90 minutes. PE have confirmed that on neither occasion was you registration typed in incorrectly as they have checked their log for similar registrations from the same time frame as your car was parked.
I am sorry that you are finding this a stressful process and have done all I can to assist you with this issue since you brought it to my attention on the 5th December 2016. I am not aware that I can cancel these fines after such a long time laps and the reasons why particular cases have been taken to court are justified but unfortunately I cannot divulge the reasons due to confidentiality. I have attached a good link however from the AA website explaining the rules around parking in private car parks and it gives good advice on how to avoid this and your rights as a motorist. I hope you find this useful for your case. Thank you for informing me on alternative methods for managing parking however this was researched at the time and there were particular reasons for us choosing to use PE when we brought it in. There have been few complaints regarding this service recently as people are now aware of the system and I believe that changing this now would only cause further issues. I’m sure you understand the need for this car park to be managed but I do take your comments on board and will look at this system again to see where we can improve it further.
I will let you know as soon as I have further information from my manager and will ask him if we can pass onto you a copy of our contractual agreement terms and conditions with PE. May I thank you for bringing this to my attention and for your feedback.

DO NOT GET STRESSED OVER THIS !!! calm down !!
these are parking invoices , speculative invoices because you did not appear to follow their so called parking rules and their systems dont allow people like yourself (or me) to avoid these issues , ie:- like the terminal inside the building not checking reg plates against the input from yourself , unlike the registration systems they use to tap in when you get there (that is how it should be)
OR THEY SHOULD PLACE YOUR VRM ON A WHITELIST , ie:- an exemption
if PE wanted to issue a court case (or two) they SHOULD send you an LBCCC (see the newbies sticky thread for acronyms) , then you would play email tennis with them to try to avoid court (with help from here of course , dont go anywhere else unless its pepipoo forums - use a gmail email address if you sign up there)
after this they may issue an MCOL or two from the Northampton "Court" (google MCOL for explanations)
again come back for help if this happens too , you might even get help from the BMPA (google it but watch the letters)
and above all , DO NOT WORRY ABOUT IT !!
the surgery and PE are bound by the EA2010 where reasonable adjustments have to be made and they have not done this ( CM is an expert on this so listen to her)
there is a long way to go before the above may happen , and yes PE and the SURGERY can cancel it if they so wish , they just cannot be ars*d to do so, but again you will have the last laugh if they try a court case (its only small claims like Judge Rinder so again do not worry about it)
NOW PLEASE STOP WORRYING
KEEP ALL THE PAPERWORK FOR 6 YEARS , and the emails , and get pictures of the signs at the times you normally attend there too and keep them safe too
also ask them to put IN WRITING why they have failed to adhere to the Dept Of Health guidleines issued in august 2014 by Jeremy Hunt which I linked earlier , as did Coupon-Mad too

So presumably they would rather prescribe you months of Valium or Mogadon to relieve your anxiety than do what it takes and get this cancelled. Even if they paid PE the charge costs, they would be far cheaper than prescribing anti-depressants for months to be paid by the NHS.
I'd book an appointment with a senior doc and tell him/her exactly what is pushing your stress levels off the Richter and ask for either medication or cancellation.
PE have no place on primary care premises. Would the practice invite a third party into the waiting room to hassle and stress out their patients while awaiting an appointment? So, why invite them on to their car park? This is just so incompatible with the practice's duty of care to their patients. They are making the people they are caring for poorly. It's a nonsense; they're supposed to be making them better !!!!!!.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Thank you for your reply. I really hope the manager can cancel these as it really does stress me out. you say I have grounds under the equality act, but apparently I put my reg in correctly! The 90 minute over sty was taking my partner to the doctors followed by blood tests in the treatment room. The fact it took 90 minutes is not my fault! And I wasn't even aware there was a 90 time limit all I knew was I had to put my reg in the machine so they knew I was using the damn surgery!
I'm not going to pay up so I wish they would just hurry up and take me to court and stop hassling me for money. i thought it had to go to court before debt collectors got involved? Nothing I say to get them off my back had worked so I'll just wait for a court letter0
