The contract is between ParkingEye and NHS Property Services Ltd (i.e. the NHS body that owns approx. 10% of the whole of the NHS property portfolio across England). The contract was signed by the Health Centre Practice Manager and it's safe to say that he / she will not be an employee of NHS Property Services Ltd. There is no evidence to indicate that he / she had the authority to act for and on behalf of NHS Property Services Ltd.
I'm still waiting to hear back from the senior manager. In the mean time can anyone tell me what this above actually means?0 -
I've now heard back from the surgery manager. Please can you advice me on what I need to do now?
I have consulted with my manager and with my contact from Parking Eye. Please see the response from Parking Eye below.
Please note the comment “A copy of the contract must and cannot be sent to the motorist as this contains commercially sensitive information.”
My manager has confirmed that I am not able to pass on the contract to yourself for the reasons stated above.
I am very sorry but I can no longer help you with your claim regarding these tickets from Parking Eye and I suggest that you seek legal advice.
I have been advised to inform you that if you wish to discuss the matter further, you should do so by asking you solicitor to contact us on your behalf as I am no longer able to assist you with this case.'0 -
you have now concluded the "Mrs nice" with your surgery
await further assistance in starting a counter claim that will involve them
if this progresses to court the surgery/PE WILL show the contract to a judge
edit , as this is a NHS type case , would a FOI get this info (open question)Save a Rachael

How do I start a counter claim?0 -
you were previously told that the surgery had breached equality laws , read back thru the thread
I,m sat on a hill in the snow , big fumbly finger mode
and remember , as posted way way back , PE do not usually write to people for this lengh of time
if they pursue it to court a lot of dirty washing will be exposed , a lot of it in your local "rag" which will hit the surgery hardSave a Rachael

How flippin' DARE they allow patients to be sued and let the tail (PE) wag the dog (them).
You said this is all it is about so of course you do NOT owe anything a tenner, let alone £100:I parked my car at my doctors surgery to take my child to the doctors. I entered my registration number in the machine inside my doctors but as I am dyslexic I simply put the last two fidgets of my reg the wrong way around!!!
You are being harassed for a reason connected to your dyslexia and there is no dispute that your car was there with full authority which is probably why the matter went to Equita rather than court. It had been passed back to parking Eye as I didn't pay Equita. Shall I assume that as it's been nearly two years and no court action that it is just threats?
In post #11, I gave you ParkingEye's email address so use it and state you consider the matter closed because a person with dyslexia cannot lawfully be harassed for transposing two digits and this is something that ParkingEye's famously trumpeted '19 checks' should have picked up. The issue of a PCN was never appropriate and is still inappropriate and the continued unwarranted harassment from PE and Equita (all Capita owned) is discriminatory under the Equality Act 2010 and the Clinic are liable for their actions.
State that clearly the only 'legitimate interest' (use those words) is to make sure that non-patients do not park there. No other commercial justification exists and the entry of the VRN was clear enough to match your car, so that was an authorised car, without any doubt whatsoever.
Demand again that it is cancelled. Remind PE that they and the NHS Clinic are in breach of the will of the Government and as such, you are minded to show Marcus Jones at the DCLG what is occurring:

You need to contact those two journalists now, as mentioned in post #76, they would wish to hear from you not from other posters here.

Sorry for any confusion I've caused but in a earlier post I confirmed after speaking with the manager that it was not because input my fidgets wrong. I alsoways thought it was as that was the only reason I could think of for even having the second ticket. Turns out it was as I over stayed the 90 minutes while in the surgery.
There are two tickets. The first one where my mental health worker appealed as I met her at my doctors and didn't know PE was there and I thought it was cancelled, and the second one where I over stayed. for over a year I thought the second lot of letters for the second ticket was still about the first. I didn't understand that there was two and I didn't know what the second ticket was for until this month. It's all stressing me right out. I have contacted and am I. Contact with one of the journalists but I still want to know have j got about counter claiming? I do not want to go to court as this will make my anxiety even worse and this is already making me worry. The fact my doctor surgery is not helping is just maki b me angry.0 -
I have a feeling (equita involvement) that this will NOT end up in court , as as posted above , I think there is/was a problem with this site , the fact thsat they have point blank refused the contract instead of allowing a redirected look , to me meams comething
possably not the same contract that edna has a copy of? , in his case it was made available
CM , and others , can a FOI be done for this?Save a Rachael

That's why I think the journalists' interest will assist you and there will be no need to counter claim if PE do not make a claim, cancel them.
- you were told the first one was cancelled. Who told you this, the despicably 'in PE's pocket' clinic staff? Why did they fail to do that?
- the second one was because (through NO fault of yours) your appointments at the Clinic took longer than 90 minutes.
Why on earth do they have that restriction? How can that work where people like you might have back-to-back appointments.
It is unforgivable that you are being put through this and the entire regime is against the NHS car parking Government policy, which was first announced by Jeremy Hunt way back in 2013 and has caused memorandums to come out to NHS Trusts ever since. They can't pretend they don't know that this regime is contrary to Government Policy.

NHS Trusts/NHS England are subject to FOI. But there really is no point trying to get the contract, red herring which will stress out this OP.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
